There aren't a whole lot of "violent dudes like gangs" in the middle of nowhere NH. Believe me, I know. I'm from the same area Jlee patrols. This is what cops in my area's primary job is, to keep drunks from driving as well as theft, minor drugs, etc.

The biggest "gang problem" in my city (only in name) was a group of teens who hacked the head off a dog of an old man who yelled at them to get off his lawn. I think some them tried to beat up a soldier in a graveyard. They got owned by one soldier. Jlee is even further north (iirc) where that stuff doesn't really happen.

And before someone retorts "there are gangs in Manch and Nashua", remember, that's southern NH, not most of the state. Very little of the state is anywhere near that urbanized.

IIRC he said he was called out there by someone who knew the drunk guy was in the car. And it is also the law.

I think you must have missed the part where the drunk guy here wasn't actually driving. Either that or you're the one trolling...

What about if a person refuses a field sobriety test? They can legally refuse the test with 0 consequences. The only test required by law is a test of a person's BAC.

Also, it's been mentioned before in this thread, but do you pull people over who pass you over the speed limit if they are going like 5-10 over?

all depends on the state. in MD, you automatically consent to taking a field sobriety test by getting your driver's license. if you refuse, the officers are allowed to take you to a station and do a blood test, IIRC.

Seriously, giving a DUI to a guy sleeping one in his car in a tavern parking lot is as about as pathetic as law enforcement gets.

passed out is not "just sleeping".

And I thought it was commone knowledge if you are going to sleep it off in your car, to do so in the passenger or back seat, with no keys in the ignition.

Everyone knows this.

Right, because passed out drunk in a car on the side of the road (in a NO PARKING area, no less) means he was "just sleeping"? I suppose you would have rather him driven off, killed someone, and then I could arrest him?

He called me today and thanked me for what we did so the situation wasn't any worse.

Everyone also knows that many cops happily lie in court too about which seat the guy was sleeping in and where the keys really were.

I think he was completely justified in giving the guy a DUI. The guy had the key in the ignition so it's easy to assume that the guy intended to drive and was obviously too drunk to do so.

I think what got him was parking in a no parking zone, that kinda drew attention to himself and hence was called on. I bet if he had parked somewhere that parking was allowed, no one would have called.

Well, I guess next time I get dispatched to a medical emergency / criminal incident, I should just NOT SHOW UP. I thought you wanted to see tax dollars at work, not spent ignoring emergency calls from the residents in my town.

Do you have any idea how much of a headache a DUI report is? You're batshit insane if you think I do it "for revenue". Or maybe you're just an idiot....but either way, WTF...

In NH, refusing a test after you've been arrested results in an automatic license suspension.

I have never stopped someone for less than 10 over unless they were in a school zone, I was on a specific speed enforcement detail, or if they violated some other traffic law.
