What I'm saying is don't bother going to court when you know you are guilty. Did he or did he not, even in his own estimation, exceed the speed limit by an amount that virtually any officer would issue a citation for? The answer is yes. Only a dick would attempt to get off on a technicality in this case.

I wouldn't go as far as saying don't bother going to court - you usually have a good shot at being able to plead guilty to a lower or even suspended penalty. It's almost always in your benefit to at least show up and talk to the prosecutor.

But trying to weasel out on crazy technicalities is a good way to get the book thrown at you. Remember that traffic court judges sit in traffic court all day every day. These "defenses" will not be novel or convincing to them. They will probably find it annoying and insulting, which does not work in your favor.

1. You were going 30 in a 15 by your own admission. Pay the fine.
2. The best you can do is to go in, admit you were speeding, and ask for a fine reduction. Don't be a dick and you'll probably get it.

Normally I would be all for fighting this in court, but you were going double the speed limit. WTF is wrong with you. How much is the ticket? It may not be worth fighting if there are going to be court costs involved.

Pretty easy to beat a pacing ticket if you get the right lawyer. I don't think a vehicle's speedo calibration combined with the obvious human error involved in pacing would be very hard to beat.

I did read up that not having your lights or sirien on while speeding is illegal, and thus they illegally obtained the evidence proving you at fault, and thus it would be thrown out. Similiar to an illegal search without a search warrant.

Please say that in court and video tape it so we can see the judge's face.

This sounds like the Oceano dunes.. if it is, it's a 15mph speed limit because there are no lanes (duh, it's the beach) so you might have cars/trucks going past you on either side, and there are often people walking around on the beach side and ocean side. Map for reference assuming it is Oceano - the skinny part of sand is the "sand highway", then it expands into the dunes as you move South.

Yes, most people go faster than 15mph there, but that doesn't make it less dangerous especially since many of the people are drinking before/while they drive. Look at how many people die at the dunes each year.

As an actual lawyer who's done actual speeding tickets, here is how things are probably going to work. About 200 people will show up for the court date. The prosecutor will say anyone wanting to plea their case for a lower fine, get in this line. 198 people get in that line. Prosecutor says anyone who wants to plead not guilty, get in that line. 2 people get in that line. 3-4 hours go by and the judge and prosecutor takes care of the 198 people pleading guilty. The two knuckleheads who plead not guilty because of what they saw on Judge Joe Brown or Boston Legal then get to try their cases (if the prosecutor gets to them, if not, come back in the afternoon!). Trial goes something like this. Prosecutor to cop: "was that guy speeding?" Cop: "Yes" Pros: "how do you know?" Cop: "I paced him with my properly calibrated speedometer." Pros: "Thanks"
Knucklehead: "But . . . but your lights weren't on! And I was only going 30 not 35! So I was 15 mph over speed limit, not 20! And everyone speeds there!"
Judge: Guilty. If your plea fine was $50, I'm going to fine you $500 for wasting my f'ing time. Oh, instead of being able to get rid of your license points by going to driving school, you get the full points and will have the pleasure of paying 3X's as much for insurance for the next three years."

Word on the street is that they get OT for court, and normal pay for writting a declaration. either way, i am planning on being a thorn in her side.

GOOD IDEA! Stand up for your right to speed on beaches! You sped and got caught, now pay up. And slow the fuck down. Where's the fire? What if you ran over a kid or something?

I can understand speeding on freeways or some streets, but a BEACH? Really? If you speed there, were DON'T you speed?

I was just commenting on her choice not to issue a "reckless driving" charge, which I believe she could have since I was supposedly 20 over the speed limit.


The speed limit is extremely low, and very rarely enforced. Down the beach further it's a free for all(with 15mph signs posted every where). it's more of a beach freeway than a beach.

I had two fairly specific questions and so far the comments have not really addressed them.

You really have no clue do you......when pacing your vehicle the police do not have to have their lights or siren on until they are sure you have broken the law.....sorry Jedi 1 your dumb ass -- 0 !!

The whole system is BS. It has nothing to do with safety it's all about revenue generation now. It's your duty as an american to fight all tickets, to throw a wrench into their corrupt system. Otherwise just bend over and take it like a man.
And try and delay everything for as long as possible-a lawyer told me that.

This.

Your better off pleading out to "Failure to obey a traffic control device" (the speed limit sign) or whatever lesser charge the DA is willing to hand you. One that puts no points on your license.

Speeding is expensive. I know.
