if so, that's probably why you got pulled out of the car

The best response would probably have been 'No officer, I'm the designated driver.' Any smell of alchohol could be attributed to your passenger.

On a side note, anyone ever see the DUI commercial where the drunk rolls down the window and wine/beer comes splashing out? Seems like they are trying to convince you that cops are omniscient and know when you've been drinking. That way when they ask if you've been drinking, you are conditioned to say (with a resigned sigh) 'yes' even if it really was only a few drinks two hours ago.

Why would your driving record have any bearing on whether or not you're sober? That and you can't slip up on an eye test. They move in a jerky motion (sober) or they move smoothly (drunk). You don't have any control over that.

Methinks the i love you in this situation is you.

Other way around, they move smoothly when you're sober, jerky when drunk.

I was pulled over 7-8 years ago by a cop who probably was out looking for DUIs. I had just come back from meeting a friend (for coffee and dessert of all things, lol), and swerved in the road while changing CDs. He made me do a bunch of tests and gave a me a breathalyzer, after which I explained to him what had happened. He still ended up writing me a ticket for going 39 in a 35 zone.

Got pulled over once at 4:00 a.m. Stopped drinking at 11:00 p.m. and didn't drink much. Passed the field tests, so he gave me a ticket for 45+ in a 25 and said he was lucky I didn't get a fleeing (lol) since I turned down a side road (before he put his lights on). Took him to court and won; he was pissed off and looked like an idiot.

If I knew I was below the limit and I was given a choice between field sobriety tests and a breathalyzer I'd choose the breathalyzer, even a crappy portable one. The reliability of field sobriety tests is a joke, and you stand a decent chance of failing them even if you're sober.

I had a friend, fairly big guy (6'4, 200 pounds) who had one drink over the course of an evening. He got pulled over, failed every FST (he's an uncoordinated klutz) and then blew a .02. It boggles my mind that discredited, unscientific BS like FSTs are even allowed anymore.

There is actually a law in NC that you can request to take a breathalyzer right off the bat. If you get the feeling that you are going to be arrested and think you are under the limit you can request to take the test before SFST's. Blow under .08 and you are likely to be on your way. Of course if your calculations are wrong and you hit a .08 you've screwed yourself. If your right an arrest can be prevented. If your arrested and taken and blow a .06 you have still been arrested even if your not charged and get to tick that block from now on.

Tick it on what? Everything I've seen is have you been convicted.
