i just got a new Maxtor 120gig and i got everything installed and it is making a scratching sound when there is disk activity, its not a click of death, should i take the drive back or is it no big deal
If it is the one that was 100gb +20gb at BestBuy, RMA it. I had a 4 out of 10 go bad with the scratching noise. You can write 0s to the drive and it will work fine for a while, but the second time it crashes on you, it is twice as hard to recover your data.

I would run Maxtor's utility against it to make sure it is ok. Clicking and popping and chatter is normal but scratching doesn't sound good to me.
