HELP!! Amazon A to Z claim

So here is my problem. I ordered a Samsung Galaxy S4 on amazon from a third party seller who had 92% feedback. Phone was shipped to a Miami address then shipped to Jamaica ( where i live). I just received the phone and its a fake chinese version! Really flimsy, only 4GB of memory, no air gestures, also used, camera is crappy, etc. Checking the sellers profile he received a 5 bad reviews of persons who also ordered S4 and received fake ones after i placed my order.

My issue is, on his profile he states a 20% restocking fee if returning item, Phone cost $614 so that is approx $120 also for me to return the phone i have to ship it from Jamaica to the USA address which will cost $50. Will i have to pay the restocking fee and also the return shipping fee? Is it possible if i win the case (dont see why i wouldnt) to keep the item and receive a refund? (the last line may make me sound like im a fraud, but i am being honest)

1. Email the seller and ask him.

2. Email Amazon and ask them.

lol thanks for the reply...i did contact amazon, and i emailed the seller. Amazon says it gives the seller up to 3 days to respond and i just sent the email couple hours ago. So instead of waiting 3 days for answers i was wondering if anyone here could provide help. Kind of nervous when i have $600 on the line.

I'll bet that Amazon makes everything right if the seller doesn't reply or wants to stick you with the restocking fee.

Thanks, im hoping Amazon just refunds me and i get to keep the item...would probably give it away to some kid to be honest.

Im new here and wasnt sure if posting links or Sellers name was against the rules....seeing as you have over 20k post im gonna assume its not agaisnt the rules.

Amazon usually protects buyers more than they do sellers. I'm sure you'll get taken care of.

Pics of phone? LOL@'international version' as a euphemism for 'fake.'

LOL funny when you think of it like that...hard for me to laugh at the moment though.

I got pics but they would be useless really because physically the phone looks exact however the buttons are really loose and flimsy. Unless i take screenshots of the screen where you see a difference in font, storage space, no air gesture menu and its really slow. However in the about device section under model it says I9500, chinese are really good at cloning. If you are not a tech guy and dont know about phones, you would definitely be fooled. Then samsung would get a bad rep by some customers when they actually received a clone sigh.

Trust me i was fooled for 10 mins. Also another give away was the box, it didnt come with official instruction booklet and the box was smaller.

If it's an unofficial fake/knockoff, the seller is at risk of having his account banned. But if it's a foreign version, it may be listed wrong. Either way, it sounds like the seller is wrong, and Amazon and the seller needs to address the issue.

Looks like Amazon banned him. Don't make the mistake of re-listing the phone like he did, or you may get banned too.

its definitely a knock off, if samsung was selling this phone they would be out of business already. Tested my S3 booting up time versus it and my S3 booted twice as fast. Also it comes with 4GB of memory...dead giveaway. Trust me i would never sell this back to anyone unless i make the buyer aware that its a chinese version. Already making plans to give it away to a kid though unless i have to return it to amazon.

You should be ok. I used to work for Amazon and they take A-to-Z claims pretty seriously. It's virtually impossible to lose money as the buyer...

Did you use a credit card? If so, dispute the charge if Amazon/3rd party doesn't give you your money back.

yeah i did use a credit card and i sure will! Lets hope after the next 2-3 days i will be posting here with some good news.
