A $100 million claim on behalf of a 6-year-old survivor is the first legal action to come out of the Connecticut school shooting that left 26 children and adults dead two weeks ago.

The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.

"As a consequence, the ... child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined," the claim said.

Pinsky said he filed a claim on Thursday with state Claims Commissioner J. Paul Vance Jr., whose office must give permission before a lawsuit can be filed against the state.

"We all know its going to happen again," Pinsky said on Friday. "Society has to take action."

Twenty children and six adults were shot dead on December 14 at the Sandy Hook Elementary School in Newtown, Connecticut. The children were all 6 and 7 years old.

Pinsky's claim said that the state Board of Education, Department of Education and Education Commissioner had failed to take appropriate steps to protect children from "foreseeable harm."

It said they had failed to provide a "safe school setting" or design "an effective student safety emergency response plan and protocol."
Pinsky said he was approached by the child's parents within a week of the shooting.

The shooting, which also left the gunman dead, has prompted extensive debate about gun control and the suggestion by the National Rifle Association that schools be patrolled by armed guards. Police have said the gunman killed his mother at their home in Newtown before going to the school.
I think this makes me more sick to my stomach than the actual shooting.

You should find out who these people are and tell them that this shooting "doesn't matter" and that they should get over it.


That's how you said you felt in the other thread. Just send them a letter..of if you're feeling man enough, go find them and tell it to their faces.


More people will sue. Wait until the wrongful death suits pop up.


Are these parents exploiting their child, sure. But..they DO have a case...now matter how lame it is.

No other way for them to get into the 1%.
I thought Newtown was already in the 1%.

According to Wiki, Newtown is 95.14% White, with a median family income of $119,175.

I think the only lawsuits that should be allowed should be by the families of the victims.

The rest is just greed; people looking to take selfish advantage of the tragedy.

Thats what this is about, they just want to make some quick money and the lawyer doesn't care at all.

The Today Show (this morning) stated the the school system was immune to such law suits in Connecticut unless given permission (whatever that means).

people with bad intentions entering schools is certainly common. That's why schools have locked doors.

A couple of points.

1.Filing a lawsuit isn't winning a lawsuit.

2. lawsuits serve purposes other than compensation for victims. They are an orderly process for looking at an incident in as unbiased a way as society has come up with, to identify problems, people who make mistakes, or don't, or people or systems that are or aren't culpable.

3. It is outrageous to ignore the effect this incident had on the children and people who didn't die, probably only because the police responded quickly.

Do you all really have no sympathy for a young child who will live the rest of their life knowing there was a person who in all likelihood wanted to kill them ?

I don't have $100 million worth of sympathy.

Maybe they should just cut all school athletics and arts programs state wide in Connecticut to pay for all the Sandy Hook lawsuits.

people with bad intentions are everywhere. might as well make any public area with a large number of people a maximum security prison now since it is theoretically foreseeable that someone with bad intentions could take a semi-automatic firearm, explosive, or other weapon and try to hurt a large number of people.

frankly, it's quite silly. if the school had had information that lent credible evidence to this attack being planned, that's one thing. but i can't possibly imagine that that is the case.

This is pathetic. There is no case here. They are just being greedy assholes, and I detest every one of them. And if you agree with them, you're an idiot. I see several here. Sue to make it even harder on our education boards to get what they need, and want. That's the answer. I swear I wish I could fucking punch these idiots.

The only thing this lawsuit will potentially do is make money for Irv Pinsky at the expense of the Connecticut taxpayers.

I think the school's insurance should cover psychiatric counseling for any students of Sandy Hook Elementary School that require it after this horrific incident.
