Hit by car running red light

Happened yesterday at the intersection of 355\gunners branch road in Germantown. I was headed westbound on Gunners Branch crossing over 355 and entering the adjacent shopping center to go to the gym. I had a full on green light and was only a few hundred feet behind a car that had turned left. As I crossed over the highway a jeep going at least 50 mph runs the red light and crosses directly in front of me. I had little time to swurve and hit them in there back quarter panel on the driver's side head on. They changed there tire and bent some metal and drove off but my car my VW Tiguan had internal damage and likely had the full cutoff engaged as it wouldn't start.

The best part is the stupid bitch claims she had a green light also. I don't see how that is possible considering I had to cross 4 lanes of south bound traffic and 2 lanes of north bound to get to her. Each lane had cars in it so if her light was green I would have hit something long before her. She didn't say much to me after I initially screamed at her. I think she knows she screwed up. Luckily for me she has insurance but no way I'm suing because her address is listed as a trailer park.

Well, you don't sue her, you sue her insurance company. But I'd go after her trailer too. Shit like that pisses me off. There is no reason to run a red light like that. You're lucky she didn't kill you.

Other than my car I have nothing to sue over. I wasn't hurt and am not a good actor.

I saw something similar happen right in front of me and gave the person who was hit my number in case the jackass that ran the light claimed he had a green.

This one. In this case with no witnesses it is hard to prove who had a green light and who had a red light. Just let insurance sort it out. Overall it is lucky that she didn't t-bone you and case physical injury to you. All that was hurt where the cars.

I wonder how this usually works out... Say said jackass did claim he had a green and also had "someone" who said they were there and saw it and gave him his number? What then?

Yeah, it's my word against hers since nobody stopped but I think the situational evidence is in my favor.

When i was talking to the police officer he said that since there were no witnesses his involvement is limited but he does have times when he thinks someone is more right than the other. He accentuated that last part, not sure if that amounts to anything other than for my piece of mind.

Yup, that's why I was SO glad when the guy that T-boned us running a red light admitted it to us, the cops, and his insurance.
Settled quickly for a good sum, and got rid of a piece of crap car that wasn't even that old in the process. (a 2008 Pontiac G6, it happened in 2010)

Had this happen to me last month, hit someone that ran a stop sign. The guy tried to say it wasn't his fault. Luckily it was obvious it was because I didnt have a stop sign, and the cop who happened to be sitting in his car ten feet away that saw the whole thing said otherwise.

Just because somebody has an insurance card, does not mean they have insurance.

Also, as mentioned, you don't really sue the person, you sue the insurance. Most courts only award you the maximum of their policy.

Even if a cop writes a ticket, the insurance companies perform their own investigation to determine who is at fault. In situations of he said she said, the insurance companies duke it out. In most situations, her insurance would find you at fault, and your insurance will find her at fault. Except of course when it is cheaper for them to do it the other way around. You do have comprehensive and collision coverage on your car yes? not just liability? If you do, your insurance will go ahead and pay for your car no matter what, you are just out your deductible. Then they fight with the other insurance for who is at fault, and if possible get you your deductible back.

A few weeks ago I witnessed a similar accident. The light was green for a good 3 seconds or more when this van blew threw a red light and another car that had the green hit it. I had a really good view of the accident and the green light as I was sitting in traffic waiting for that same light to go green. I pulled over and waited for the police to come and gave my statement.

Did you call the cops to have the come to the scene? Have camera and take pics of the scene? No witnesses, good luck.

If you need to prove she didn't , setup 2 camera and record the light pattern, or visit your local DOT and ask for the timing and light sequence for that location, it'll show at x seconds, the light turns green, yellow, red, etc.

Hopefully you have a witness. Traffic lights have been known to malfunction from time to time, though not likely obviously. But if she sticks with her guns and says she had a green light and you do the same, it could spell trouble.

Unless you have a witness, a police report indicating otherwise, or video of the incident, you have a word vs word claim and her carrier will likely deny. They may even try to go after your carrier for her damages if she has physical damage coverage, which appears unlikely given the circumstances.
