HOA trying to get WWII vet to take down his flag pole

We're more civil than P&N so I'm posting here. Apologies if it's in the wrong place, but with all due respect to the other subforum, I think we hate HOAs more here.

What gets me is that this is going on in Richmond, VA. Never thought they'd tell a 90 year old war hero to take down his flag in this state. Seriously, a war hero too. A Medal of Honor, Silver Star, Legion of Merit, Bronze Star, and 3 Purple Hearts.

According to the video flag poles aren't even forbidden, they just have to be pleasing to look at. Well how fucking subjective is that?

I've got to play devil's advocate.

Read this article for a different take on the situation. This article says he was told he could not erect a flagpole and he went ahead and did it anyway.

It's disgraceful how the media can slant a story to get the reaction they want. Which of these stories if either is factually correct? I don't know.

Before you all crucify me, please know that I am on his side. Besides hating HOA's, i don't feel flagpoles are an eyesore in any way shape or form. A good friend of mine has had one up for over a decade and I just noticed it this summer. They blend in are are not readily noticed IMO. I must say though that he does not fly a flag on it.

Citation

For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.

Leave it to an HOA to tell him he can't have a flagpole...

What gives some 3rd party organization any authority over that stuff anyway? It should be up to the city, but regardless that's really stupid, even if it was the city making that decision. Have respect to the ones who faught for that very land.

I live around the area where this is happening.

The guy applied for it twice before he even moved in and was rejected both times. He still moved into the town home knowing they didn't allow it, and he still put one up.

Not knowing much about him, I thought, what a dick, they said no and he still put up.

Then I read about the guy and there's no way I could deny him that flag pole. I know a lot of people are trying to argue, if you allow him the exception then others will start demanding exceptions be made too. You know what though? No one else has as strong a case as him.
I don't care how ugly they think that pole might be for the little bit you have to see it from dusk to dawn when he doesn't have the flag on it, that man deserves to have it. I'm not usually for giving people special treatment because they did "something", but he didn't just do "something" he IS a hero.

I'd take them all the way to court just to A) drain their money, which leads to B) raising fees which pisses off everyone there, C) become "the" HOA to ban a vet's flag, and thus D) have the potential to decrease property values.

I'd take them all the way to court just to A) drain their money, which leads to B) raising fees which pisses off everyone there, C) become "the" HOA to ban a vet's flag, and thus D) have the potential to decrease property values.
From a legal standpoint I don't know if he can take them to court. He has no "civil rights" when dealing with a HOA. Which is one of the reasons HOA's are flourishing. Basically, they can do pretty much what they want, as long as its in their contract.

Of course, I agree the guy should be able to fly the flag.
On the other hand, what about other political flags?
The HOA, I believe is within their rights to only allow American flags.

Oh, definitely. Hell, I'm licensed in VA and if I called the guy now, I'd probably be one of 100 that did so.

I hope he manages to counterclaim for a fair amt of damages. Bankrupt the HOA.

From a legal standpoint, the HOA wins. But, they are also allowed to make exceptions and if they know who this man is and what he's done, I don't see how they couldn't let him keep the pole.

I can understand if you just get a form with just a name on it that says "I want to put up a 21ft flag pole" and you say no to that. But, you do not say no to this guy after knowing what he has done!
