In Maryland the age rule is irrelevant when you are a "person of authority".
Yes, she/he can be 16/17 and it's OK. But when you are a teacher, doctor, police within that venue for the profession it's illegal. I think that might have been the issue here, not sure.

What she did was bad, but the zero-tolerance crowd doesn't stop to think of the social ramifications of prosecuting people for such crimes.
1. She'll do time at the taxpayer's expense. Prisons are already bloated, poorly-run, for-profit institutions as it is.
2. She will be a registered sex offender for life and the will never shake off that stigma.
3. That status will kill her ability to ever have meaningful employment that will support her or her children.
4. She'll probably end up on some degree of social aid eventually.
5. The boy will be telling his story for high-fives and free beers for the rest of his life.
Before someone starts yelling "think of the children," this kid is only months away from being able to vote and eligiblity for the draft. Old enough to die, but not to fuck the person of his choosing.
