Ok, on the e-bill, it's under Billing -> News and Info... It changes every month and sure enough you can see the no holidays and regulatory charge thing on there. I talked to a CR and they got a memo that they couldn't let you off without the termination fee. So to get out without the fee, you have to escalate and talk to a manager. They will take your number and have one call you on monday. It's not really worth it for me having to switch to cingular and port my number, or I would press it further. Just wanted to share what I learned to help others.

i called and was told i couldn't be released from contract, only that i could be credited the 40 cents per phone. i'll cherish my saved $4.80 forever.


btw, it was also mentioned by the first women i talked to before she gave me her manager that "we can't release you from contract because the prices fluctuate all the time, infact a few months ago we reduced prices!".

just called and the lady said she just got an email today from her superiors saying that you would not be penalized for canceling ... just now 10:25pm central time!

All I said was,

"I would like to cancel my service because I received notice of a $.40 administrative charge in August"

Then I asked her if I would get an ETF (Early Termination Fee)

and she said no!

anyone know if I can still port my number?

edit: the guy said that I could still port my number. He said he would leave my account active and that I would receive a bill for $175 but to just call him up and he would take care of it. He gave me his direct line.

Yup I got my stuff ported out also. I called in and talked to a rep a couple weeks ago and they said to get a new carrier and port my number out. After porting my number should disconnect my service with Verizon. And I called in today to make sure that I wasn't charged an ETF for my lines, and I guess one of the reps noted in the account not to charge me and ETF and so they didnt have anything to reverse.

Although my buddy tried to do the same thing and no dice. The rep offered him back the .40, barring him from backing out of his contract. I guess there was a company wide email where the reps were permitted from letting anyone out fo their contract. Which I think is BS shiesty business practices from Verizon. I'm glad I got out when I could... good luck to everyone else. YMMV.

just got off the phone with the CSR. He said those terms didnt apply because 40 cents does not have a material adverse effect on me. Damn you Verizon! im a poor college kid!

Civilicious - Read back a few posts (well, many posts) to get some good words from the lawyer types. An increase, regardless of size, has a "material adverse" effect. It is not up to the CSR to tell you that its not. The increase is "adverse" since it causes you to pay more (not less). It is "material" in that it is a real cost. There is not an out for "not a big deal, shutup and pay the 40 cents".

Call back and respectfully disagree and ask for a supervisor. Ask for names (or some other identifying information), write their statement down and read it back to them, ask if they agree that your notes are correct.... Then ask them to hold on so that a second person can witness their statement. Don't let your age or experience hold you back from being quietly assertive.

This thread is correct. I actually used this info to help a coworker get out of a plan a few weeks back. He got very little pushback but maybe we got lucky with the rep. In any event, it is not up to Verizon to determine what constitutes a "material adverse effect" from your perspective. The change is NOT part of the original arrangement that you agreed to when you signed the contract, and therefore they cannot force you to accept it under pains and penalties of the ETF. The admin fee is not simply a federal tax being passed along directly to you, it's just a means of helping them offset their infrastructure costs ($.40 x 47 million subscribers, every month... you do the math). This is exactly why they had to inform all the customers of the change, because BY LAW they must provide subscribers with fair lead time to object and opt out of the edited service agreement.

Sweet deal. I got out of Verizon a few years ago and attempted to dispute the $175 fee; they wouldnt have it. It really screwed up my credit for a while.

this is true, vzw dropped the $0.45 (might have been $0.40, i forget) fee they were charging due to local number portability

The GF had the same problem with them saying that this did not have an adverse material effect. The lady offered her $9.60 credit on her bill saying that eliminated the $0.40 x 24 months material effect that it would have. I got on the phone and pointed out that the notice said the amount could change at any time and that we didn't want to have to call and ask for a credit every time Verizon deemed it necessary to tack on fees. After about 10 minutes of arguing she finally gave in and let us close the account with no fee.

I have had a Verizon Cell Phone for about 5 years & still have it. I started back in the day when they were called 'AirTouch'

In May 05' I signed a 1-year contract for Verizon National/Broadband 'Wireless' Internet Access for $79-a-month. The service was only 75k when I started it's now 'Broadband' at around 500k. I'm not real happy with the Internet service due to its inherent 'Satelite-Type' lag problems and such.

So i decided to try this Loop-hole to end my internet service. They said No, & offered to Refund the 40 cents-a-month. After talking with them for about an Hour the Supervisor dropped my Monthly rate from $79-Unlimited-a-month to $59-unlimited-a-month.

So this Loop-hole wasn't a complete wash, I'm now saving $20-a-month. But i really just wanted out of the service because I'm unhappy with it. Definetely DSL or Cable come next May. ( I just use this service in my Desktop so I'm not getting any of it's Design-Benefits for Mobile Laptops)

Plus i felt a bit guilty trying to cancel my Known-signed mutual agreement over a mere 40 cents. So i didn't argue the No-cancellation reply & accepted the $20-a-month decrease.

So I called Verizon on the 25th of Sept. to cancel and they said yes that I could cancel on Oct. 1 without an ETF. I called against on Oct. 1 to cancel and once again I was assured that I would not receive an ETF.

I just called today to pay my bill and they charged me an ETF, after hours of arguing they are saying that I have to accept the credit or pay the fee. I told them that their contract says no where that I have to accept the compensation and they are going back and forth with me with circular logic.

They have refused to back up their reps saying they were wrong and that because it was posted on the forums that I can't cancel, but when I told them that it was on the bill clear as day and written in their contract they had nothing to say but refuse me on it.

Anyone have any ideas?

I'm thinking class action on this.

Verizon...they have been very shady and sketchy to me in the past. I just paid the ETF, screw them. What comes around, goes around, just wait until Wimax takes over the industry and everyone will be using VOiP, then we'll see who's laughing....unless of course Verizon jumps into that service as well.

Nothing can be more horrid than sprint. I moved to an area with no service, and they wave the ETF. I called and was told to go to a store, the store told me to call. I finally got it figured out and got rid of sprint. Saved money on my ETF fees, got rebates for phones, which I sold on eBay. I made a few dollars out of it

I've had verizon for the past 2 years and been extremely happy with it. I've had Sprint, T-mobile, AT&T/Cingular as well and they all sucked in southern california. I'm sticking with verizon when my contract comes up again next month.

On August 24th I received a written notice that Verizon was adding an Administrative Fee starting October 1st. It said this fee was not a tax, and that it was being added in accordance with the paragraph in the Customer Agreement that is quoted in this thread. I called them on October 8th and told them that this charge materially adversely affected me and that I was cancelling my service. I asked them to note on my account that I was not to be charged the Early Termination Fee in accordance with the Customer Agreement. The person I talked to said it was no problem and I wouldn't be charged the charge.

On October 9th a bill was generated for 2 Early Termination Fees, plus tax. They now say that the fee is a tax, and doesn't qualify for getting out of the ETF. The bill specifically says "this is not a tax." Every person I talk to now (all of them are supervisors) insists that it is and they will not remove the ETF charges.

So then I pointed out to them that my contract expires on October 24th, and I have already paid them in full through the end of the contract, so they can't charge me this fee anyway. I know their computer shows this date because I called twice before and asked them when my contract was up, and T-Mobile asked them too. They always said October 24th. After I pointed this out they told me that I have to fax them something in writing that is dated after March 1, 2005 that states that my contract ends on that date or else they are going to consider my contract good until January 2007. I don't know what they expect me to fax them. They don't print the contract dates on the bills. The only stuff I have that says the date on it is the original contract, which is dated October 24, 2003.

I have asked for a mediator. After that I will take it to arbitration. They aren't getting any money from me.

The point is: be careful dealing with these assholes. They tell you one thing then bill you another. It is fraud, plain and simple.

$100 says they added another year to your contract.

does this work for plan renewals? cause i lost my phone so my parents wanna renew the verizon plan so that they get more minutes and they think they'll be able to get a discounted phone for me (which won't happen) so could they upgrade they're plan then cancel?

I don't understand. You want to sign a new contract, then cancel it? That would, of course, not work. The new charge would already be part of the new contract, giving you no "change in terms" to base your cancellation on. Besides, cancelling a renewal just puts you back on your old terms. It does not end your service, and you lose all free or promotional phones.

I originally tried the 40 cent strategy and was denied by everyone. They offered me a $9.60 credit like everyone said before. Luckily I am getting sent temporary duty for the Air Force and was able to cancel without ETIF for this. So now I get Verizon's nine bucks and no contract. HAHAHA

Just be wary anyone thinking of leaving and going to Nextel. If you port your number to them and if the service doesn't work out and you want to go somewhere else, Nextel will charge you $25 to take you number with you. I had that happen after 4 days of service that was horrible in my area. I ended up contacting the State Attorney General's Office to get my $25 back they tried to charge me to take my number with me elsewhere!

I called about this about 2 weeks ago, they said their legal department said they should not let anyone out of their contract but instead refund the $.40/month
