Got an email this morning from 2checkout.com stating that Cyberwings had refunded my $3.90 that I paid for a years worth of service (I still can't believe that rate!)

Also got an Help Ticket response from CEO apologzing for the delay.

If they are doing account setps sequentially like they said they were, I can confirm that they haven't done even 4 AYW setups since very early Monday morning (> 55 hours). The last confirmed AYW account setup was #54, I'm #58. I'm not sure where they are focusing their attention, but I sure would like a status update!

So am I understanding this right from the Anandtech community people that are involved in this fiasco...........

less than 5 of you people have gotten an account set up? Some have received confirmation of a refund?


There is NO WAY I'm requesting a refund of my $4. I'd rather let this ride WHEN a lawsuit comes down on CEO Shawn. This guy KNOWS that if he issues a refund to the pissed off that at that point they have no legal rights against his company. I'd rather have him hold onto my $4 and get a slice of the legal pie WHEN that action is launched.

I've heard through what appears to ber a realizbler source that supposedly Cyberwings is already behind on the bandwidth bill.

Watch out for another round of sales!!!

Do you actually expect Shawn to stay here and face a lawsuit? He is either A. going to flee somewhere and you'll never hear from him or B. Get rid of the money by allowing someone else to hold onto it and claim he is bankrupt. You can't squeeze blood out of a rock.

He has a reseller account, not an individual account. The highest ticket # for individual accounts that have been setup is still #54.

I never got my setup email for my $3.90 account so it's kinda useless to me. I should request a refund but it would be cool to be in on a lawsuit considering I was gonna use the account for a business and he would be accountable for lost sales, etc.

Nice try, but but it's unlikely you'd be able to get more than $3.90.

Perhaps you can get the lawyer of the fat guy suing McDonalds to take your case and sue for "emotional distress" or some such garbage.

With all the talk about Cyberwings--it's up, it's down--it'll be up, it'll never come back up....I want to know two things: Is anyone's site back up (other than Cyberwings) and has anyone ever reported that they received their promised refund from Shawn White?

A very small number of people have their sites back up. There are even some right here on this page.

As for refunds, people who paid by 2checkout have reported receiving refunds to their 2checkout accounts. People who paid by paypal (or other means) are supposed to have a check mailed to them, as I believe that CW had their account restricted.

I have ticket 1579 for a refund and 1580 for the Questionnaire to get an account reinstated. No word yet on whats happening.

Uh, he is not responsible for any of your intentions... likely the 3.90, but not lost sales on something that didn't exist. I love how people are seeing millions of dollars in lawsuits because of pain and suffering and stuff like that, If there is a class action lawsuit, someone is going to have to pay a lawyer, unless they do it for free. Knowing the people who are mad about possibly losing 4 dollars they likely would not want so spend over .99 cents an hour on a lawyer after PM/Rebate/shipping etc, and would likely settle for a refurb. The .99/hr lawyer would likely just mess up the entire proceeding and then the ball of wanting refunds/not happy with my service that I payed $4 for would continue

sorry for the rant, not directed at anyone, I have been working on the new world trade center design proposals, and I haven't slept for than 45 minutes or so a day for about 10 days... =)

Im ticket number 580 with a personal account - and no word yet

A couple things I'd like to point out also about legal action.

Generally in a class action lawsuit, the only people who make money are the lawyers who file the suit.
Lets say, for argument's sake, there were 18000 accounts and each cost $3 for 1 year of service (I know this is not true).
We estimate that each account was active on average 50% of the time (I know this is not true).
So the lawyers would sue for $1.50 for each of the 18000 accounts, or $27000
The lawyers would take at least 33%, or $9000 (Which obviously wouldn't be enough to warrant the case for the lawyer).
The remaining $18000 would be split between the members of the lawsuit (us) at $1 per person.

Even if a class action suit was filed (and won) do you really think cyberwings (Shawn) has any money left? Winning a settlement, and collecting a settlement are two ENTIRELY different things.

The highest ticket # for AYW account is still #54? can any1 confirm this somehow. I am #208, i don't wanna wait till next year to get my site back up? how about those with 2000+ it really sux for them.

Update from the helpdesk...

We are finding that a lot of people are filing for their Individual accounts to be converted into an AYW account, and then, back to back, they are filing for a refund on their Individual accounts. If you file to have your accounts combined into an AYW, you do not also qualify for a refund. We are checking every payment ID, in PayPal & 2Checkout, to be sure that payment ID's we are converting into AYW were not already previously refunded. We will also be going back over every ticket individually to double check every payment ID when our rebuild project is over to be sure those who got refunds do not also get service - or worse yet, double refunded. Chargebacked refunds will not also qualify for a direct refund from us as well. We are double checking all direct refunds prior to them leaving our office.

I will be in our chat room this evening to talk more.
