I got some good news guys.

I called Egghead up just to get info on their shipping
practices (I did not mention the RAM). I asked if it
was possible to change shipping method after the order is placed.

She said "no" because once the order is placed it goes directly
to the distributor and gets shipped immidiately. I asked her how long
before we get confirmation then. She said 24 hours later max. So this
look like it might be good news for us.

like i said before, lets everyone that bought one chip in like 10-20 bucks to get a lawyer.
maybe we can do like 10 bucks per stick for the lawyer.

Interesting... if Egghead does indeed go through Ingram Micro as its distributor, the following link might be of interest to some of you:

This is the same exact product (character for character - 32X64-8 256MB SYNC PC100 168PIN 3.3V 100MHZ DIMM) as this memory we all bought. And guess what? IT'S LISTED AS BACKORDERED.

So has Buy.com anticipated that Egghead will be exhausting Ingram's supply of these chips? Or were they already low? Perhaps Egghead started this scam KNOWING that there were only a few chips in stock, and that they could have a big publicity stunt and still look good when they are gracious enough to "ship out what's left". A lot to think about...

But I have always been one to over analyze. What do you all think?

Hmmm, that is some good news, 403Forbidden. Some people have said that egghead has cancelled some orders... As of yet, no one has said anything about getting their orders cancelled, so that was probably BS.. The only other thing would be if they really had a set stock and they had run out, then it doesn't matter if it was sent to the distributor. If the orders are sent to the distributor, are things at the distributor complitely automated or would they check the orders? I don't even know how the distributors work. Does egghead pay the distributors later after the credit card has been processed or right away or something? Because if egghead paid them no matter what, the distributors wouldn't bother checking anything. They'd just send the stuff out.. As far as the lawyer goes...while it'd be a good effort, chances are it'd fall apart. Who would step up to pay the lawyer for the consultation and get everything organized? Besides, how would anyone trust this person to send them the money to pay the lawyer. Besides, it'd be hard to get everyone that bought the ram involved...since it was at hardocp and here, and who knows where else. Unless, there'd be some type of class action suit, but I'm not a lawyer, so I don't know how that would work out..

I got my order in at around 2am PST. I don't think I will get the memory but it's worth a shot. I did the same thing on UBID a while back on mispriced computer systems and I got around $200 worth in GC's. Still a pretty good deal..heh.

Lets document and gather as much "evidence" as we can. Print, screen shot and save everything. If they showed it "in-stock" when we placed our orders and later do not deliver, they could be held liable (from a Lawyer) under several laws (#1 False advertisement, Did not delivered product as agreed upon, Merchant breach of contract, etc) are broken. Even better if they actually charged the CC's.

If we don't get em I can arrange to talk to several lawyers (friends) about either a class action or joint-group law suit! (already quering about)

I ordered at about 3:10 AM PST and have not gotten my shipping notif yet

OT: Took 1 GOOD letter to uBid to send me my darn merchandise that I won in an auction. Their error cost en a few $$$!

Hardocp is a web site. If worse comes to worse, I wouldn't mind $200 GC's. Like I said before, if they are backordered and have been, how come someone already got a shipping confirmation? I have a BX system right now, but I'm planning to get an 815E (especifically, the Asus CUSL2) but if I get it, it only holds 512MB max, so I'd have to sell off my other PC100 SDRAM, or just use it for some other system.

Call the lawyers, they will not be honoring any of the misprices. A friend of mine made an anonymous phone call asking about the mispricing. Apparently, this was not the only mispricing. I don't have the details....

Basically, all orders will be cancelled and credit cards will be refunded. If you got in through the cracks, let us know, and congrats!!!

As far as them not honoring our orders, like their catalog, they have a disclaimer on their website stating specifically that they do not have to honor their errors.

Placed two orders.

One last night, 8 sticks UPS Ground....$307 total. They have been shipped.

One this morning, 8 sticks Next Day....$558 total. "Order receipt acknowledged by warehouse"


Soo maybe I'll get them....who knows. I called EggHead, asked about their policy should prices change....they will honor the price ordered or go lower should prices drop (DONT THINK THEY WILL!).

From what I can tell, they have gone "out of stock" and will probably change part# so that they can legally say "sorry, we no longer carry that item. However, we do have similar units at $330 each. Shall I change your order?"

Who knows, who cares. EggHead had a typo...big deal. Maybe I'll clear $2000 profit...maybe I'll get nothing.

Well, that's the second person to have shipped. It's another order from last night. Chances are if you ordered last night, you might get shipped, but it might of been to late for people that ordered this morning, like me W/ the disclaimer...well, the law is above any disclaimer. If you can use the law, then the disclaimer isn't important at all. What I'm getting at is if they've already shipped, chances are you're home free.

I already have a 1GB RAM system using 512MB Modules... having this deal is great savings! I order mine 6AM this morning when there was like 10 posts... hope it ships... I only order 2 since everyone should have some, wasn't greedy enough.. now I'll have 512 for my sister's computer... but still, its only PC100.. I have 1GB of Pc133 ..ehehheheeh

Can you tell us when your order was placed? I also ordered in the early morning (around 1:15 PST) with UPS ground. I want to see if they are fulfilling orders as they were made, or just randomly picking up some.
