Yep, replacing a defective mouse is such a scam. Let me ask you this, if MS didn't have this policy, how do you think they'd handle replacements?
I think it would go something like this:
You: Hi my mouse keeps crashing my system.
MS: Yes we know. We had a problem with some past models. Your mouse needs to be replaced.
You: Ok, what do I need to do.
MS: Send the defective one in, and we'll send out a replacement as soon as it is received.
You: But...without my mouse, I won't be able to use my computer.
MS: Do you have access to another mouse?
You: No.
MS: Is there any chance that you could buy or borrow one while we work out the replacement?
You: No, why should I have to buy or borrow one because of a mistake that you made?
MS: Whoa there big boy, don't get testy. I'm on your side. Here's what we can do - we'll advance ship you one, but you'll have to pay for it in advance with a CC, then we can credit you back once the defective one arrives.
You: The more I think about this, the more I feel like your biatch. I mean, you send me a broken mouse. Then, when I want to have it replaced, you make me buy another one. And in order to get my money back, I have to box up the broken one THAT YOU GAVE ME, and send it back to you. Now, think about the cost involved in that scenario. Whether you know it or not, MS is saving money with this policy. If they are truly verifying serial numbers, then they are giving one for one replacements on defective mice that they have to replace anyway.
