Even if there are no break outs you can still get herpes, all be it a smaller chance, it still could happen. So not unless you want herpes FOR LIFE, then move on.

Also if you have herpes and know and give them to someone without telling them you have them before the contact, YOU CAN GO TO JAIL!!! and Pay big in court.

Just like if you gives AIDS or any NON-Curable thing to someone. I am sure you could still be sued even if you gave a curable one to. So if you have something you better tell them.

I know if some girl gave me herpes or worse AIDS and she knew before we got together, I WOULD MAKE SURE SHE SPENT MANY YEARS IN JAIL. And sue her for so much when she got out whe would spend the rest of her life paying me.

Be honest, think about how many relationships break up over small things, what do you think would happen if you told someone you have XYZ and its non-curable, don't think you would be together long.

I am unaware of any American jurisdiction that criminalizes having consensual sex with herpes without disclosing it to the sexual partner (though it is an aggravating circumstance in rape cases). It can definitely be a tort and incur civil liability, though.

You can't charge them with a crime - you can sue them. There's a big difference there

Tell that to the people in jail for giving aids to people when they knew they had it.
This was a big topic several years ago. Aids, Herpes, and some other things were on a list that most states will charge someone with if you spread it and know first hand you have it and do not tell the other person.

Some (not all) states have laws like this in regard to AIDS, but I have never heard of any states criminalizing this conduct in connection with herpes or other STDs. As a practical matter I have a tough time imagining such a case being prosecuted, since it would be all but impossible to prove beyond a reasonable doubt that the transmitter did not tell the other party about the infection.

Well its not what you can prove, but what you can make a jury prove.
Basic law, you don't have prove it to everybody, just 12 people.

Its like if someone was brought up for raping a girl, do you think they would believe the person if they said she said she was 18, and etc...
Just like a jury is not going to look at someone in a good light that gave someone else herpes or something else.
And if its a election year the DA will do what it takes to get on the newspaper.

That and whos going to go on TV and say "yea I gave them XYZ, so what"

I'm sure she'd be thrilled knowing 80,000 people now know she has herpies and that her picture was plastered on the internet for all to see. Think about that.

As for how contagious it is, do some reading. talk to your doctor. Understand the ramifications if you should happen to contract it.

I do applaud you for being open minded about not dropping her because of this.

No offense but I have been a criminal prosecutor for several years, and have sent a number of people to prison for years at a stretch. I am currently working on a capital case. I gather from your comments that you are not an attorney.

I for one do not prefer charges against people for political reasons, and since I do not believe the conduct you describe is even a crime in any American jurisdiction (it certainly is not in mine), I would not and could not prosecute someone for it.

The difference is that one is more serious, and is normally sexually transmitted. She would have gotten the more serious herpes by giving someone a BJ or kissing someone else that got it from someone else in the same fashion.

The lesser herpes isn't really refered to as herpes (although it is), it is just called Cold Sores. And normally doesn't come out as often unless you're stressed out. My wife's whole family has cold sores, my family and I had never had them, I got my first cold sores from my wife. I haven't had any in a long long time but I get very chapped lips and the first time I got them from her I had seriously chapped lips and I had no resistance so I broke soooo bad. Ouch. And I actually get blisters on the roof of my mouth next to my gums sometimes.
