3 questions

1)what's your usual speed?

2)how did he catch you(radar gun, airplane, etc)

3)What state are you in?

Was this by chance faster than the posted speed limit?

i beat both my tickets (the cop never showed up in court) so the Judge threw them out.

wow you guys are quick... you all rule...

this is what happened... skip over any details you don't need...

my mom and I were getting a bit late for Eid prayers (end of Ramadhan and all) and I was making my way to the freeway.

I was going about the usual speed I go on that road. This road stretches about 1 mile straight, no stop signs no intersections nothing, it parallels a runway. I was going about 50 or so... and I caught a cop in my periperal vision, i let go of the accelerator but my mms car is somewhat heavy so it doesn't slow down too quickly. the cop was in a driveway and pulled out after me... he flashed and I stopped.

he asked me if I knew why he pulled me over, the dumb-ass I am, kinda freaked and never being pulled over for a ticket before said "I dunno, was I speeding?"

He said I was going 57 in a 35 mph zone (honesly I don't think it's a 35 mph zone, this street divides a commercial and residental area also i dont recall and signs). The bastard wrote me a ticket, no doubt to fill his quota and drove off.

Because of the asshole, and this is what really pissed me off, I was 10 mins late(the time it took him to fiddle about and write me up) and missed prayers by EXACTLY 10 minutes.

I have been told to contest the ticket, but I don't know what to say.

I live in California.

I was told my someone, if he used a radar, considering I was 5-feet from a chain-link fence (municipal airport boundary) that the radar reading would be inaccurate. The problem is: how do i know what he using to check my speed?

I was also told to call the police department and find out when the officer is working, that way I schedule a court date on his day off. I doubt the ultra-rude city PD will give that informtion though.

Other than that, I don't know what details you guys want... lemme know.

If the street divides a residential and commercial area, it is most likely 35mph.

It's probably too late for this now, but a guy in our QA department got out of a ticket by asking for the calibration history of the radar gun. Claiming that how could they know if he was speeding or not if the radar gun was not calibrated??

When you go to court, if the cop didn't tell you already how he caught you, you will find out. If it was a radar detector, ask for documentation on the cop's certification, documentation of the radar gun's calibration and how many times it was repaired.

Also, check out the road and see if there is an absolute speed limit or a suggested speed limit. The absolute limits have the word maximum on them. If it is not absolute but a suggested speed limit, you can argue that you were travelling at a safe speed because there were no pedestrians, no other cars on the road, good visiblity, etc.

Also, you might want to check this site out: http://www.cleandrivingrecord.com/

Electric Amish - I think xyyz is ok because the cop has to bring in the records with him to court. At court you can bring these points up.

Plead not guilty.
Go to court.
Hope the officer doesn't show up.
Go to court again.
Hope the officer doesn't show up again.
Go to court again.
Hope the officer still doesn't show up.
Hope the judge dismisses the ticket.

That's it. Good luck and slow down.

Punk-ass-bitch cop? He was only doing his job; I don't care whether or not you want to hear it. If you aren't able to realize it, maybe you shouldn't be afforded the privilege of driving.

The least you could do is be respectful.

I'll be the first to admit that I speed occasionally (no more than 10 over, though); if I get caught, I will pay the ticket, and take the insurance 'points' for what they are.

Sorry to lecture, but the punk-ass-bitch remark bothered me. If Yawmark posted here anymore, I'm sure it would bother him, too.

This will cost you but it's better than paying the tichet + 3 years insurance. Call around for a lawyer, should be around $200- 250. You plead not guilty, send in the ticket certified mail(because you have 15 days to respond and in turn so do they, if they go over you win) etc. etc. Just get a lawyer.

How you I find the calibration history on the device he was using? Do I call the PD and ask them to provide it... or do I bring it up when I go to court? Also, considering how moody police can become when you question their judgement (totally unfair), can they stick me for anything id I decide to fight thing

Entity, do you feel much better now that you got that off your chest? Consider we have tree huggers, I guess a cop hugger isn't too far fetched. Maybe, I'm wrong in thinking cops should spend their time busting crack houses and not harassing good citizens that are in a rush to do something very important... who are very careful not to bring harm to anyone while on their way.

Cops in Cali always show up from what I've learned from every person I know whose gotten a ticket. In other states I don't think they're as consistant, but in California they always do. Of course that is the CHP I'm talking about, I don't know if local cops are as good about it.

Well, first place the ticket on a level, flat surface. Then take a baseball bat and ...

Chances are the cop will show up, and one thing to remember, speeding tickets fall under "preponderance of evidence" to convict, which, in other words means "guilty until proven innocent", many people confuse this with the "beyond a reasonable doubt" standard held to criminal court venues. Generally, you dont have a chance, but I have found, and have heard from others, your fine will be reduced if you provide a good explanation or argument. If you p!ss off the judge, however, he can Increase the fine (at least in Oregon) so you must be careful how you argue your point. Being disrespectful or arrogant will get you nowhere. Dont act like an attorney, because you're not, and the judge knows that. But hey, give it a try, couldnt hurt.

Bastard, I was going to make that joke.

First thing. If you every get pulled over again be honest and up front with the officer. Admit right up front that you did something wrong. Usually one knows when one is breaking a traffic law. I has gotten me off several times with just a warning. It has also helped when I have been ticketed because usually they have lowered the penalty.

My advice to you is that unless you can prove that the speed limit was not 35 that you just accept the ticket and chalk it up to experience. I know that I have better things to do with my time then fight traffic tickets.

Oh were I live the cops do show up if you go to court.

Now there is a great idea I speed but if I got caught I would own up too it. Not try and blame others for it. Guess its a sign of maturity, responsibilty and good upbringing.
