In Porn people get paid as actors and just happen to have intercourse while in prostitution they get paid solely for intercourse or other sexual activities. Plus Prostitution isn't taxed and the Porn Stars are.

Umm... there have been notable porn people that got STDs. I think the whole argument is that prostitution would be regulated like the porn industry. There would be frequent STD checks, actual "employers" and the whole business model. Prostitution is a legitimate business in many countries. I think Americans can be prudish and hypocritical.

I think the point of the question (which I was pondering a few days before this was originally posted), is if you pick up a hooker and ask her how much for her to star in a porno that you are making, and tape you two having sex, is it legal (porn), or not legal (prostitution)?

Hell, just go in front of the judge and say you were making "reality porn"... much like "reality tv", it stars people who cant act in a low budget production.
