Salt Lake County District Attorney Sim Gill said what Thompson did went beyond a regular DUI or vehicular homicide accident. Thompson acted with "depraved indifference" and needed to be charged with murder, he said.
"What we're arguing is that he was consciously making a decision to accelerate into an intersection which was red, and he knew there was traffic there. Our position is he acted with such depraved indifference, he intentionally set out to engage in that conduct," Gill said. "This is not an accident that happened."
When Thompson entered the intersection where the fatal crash occurred, he was allegedly traveling at 60 mph. He pushed his gas pedal "as far as it would go" when he was just 175 feet away from the intersection, the charges state.
