Thompson was found to have a blood-alcohol level of 0.22, almost three times the legal limit of 0.08. Before getting into his truck, Thompson had become enraged during a fight in his home where he argued with his wife, then punched a woman who was staying with them and a neighbor who tried to intervene.
Jurors were given the option but declined to convict Thompson of one of three lesser charges: manslaughter, criminal automobile homicide or negligent automobile homicide.

No. His dumb ass drove while drunk. You know, personal responsibility and all. You get a DL and you agree to follow the laws.

Can't you say the same thing with all drunk drivers? They may not intentionally kill someone but they don't care if they do. Otherwise they wouldn't get in the fucking car drunk.


Seems this piece of shit didn't care at all and had a history of drinking of driving. Really what kind of person does that? again and again and again.

Killing someone randomly while DUI is worse than cold-blooded murder imo. At least the latter is more predictable/manageable.

In California if you are convicted of DUI you are given an admonition that in the future, if you kill someone while DUI you can be charged with murder.

Perhaps that was the case here.

Salt Lake County District Attorney Sim Gill said what Thompson did went beyond a regular DUI or vehicular homicide accident. Thompson acted with "depraved indifference" and needed to be charged with murder, he said.

"What we're arguing is that he was consciously making a decision to accelerate into an intersection which was red, and he knew there was traffic there. Our position is he acted with such depraved indifference, he intentionally set out to engage in that conduct," Gill said. "This is not an accident that happened."

When Thompson entered the intersection where the fatal crash occurred, he was allegedly traveling at 60 mph. He pushed his gas pedal "as far as it would go" when he was just 175 feet away from the intersection, the charges state.

This wasn't a "normal" DUI.

As someone that drives after drinking regularly, yes murder. I shoot for a .08-.1 BAC and can still control my vehicle, if I kill someone give me the chair. Not the chair that costs tax payers too much take me out back and shoot me make it look like I died at the scene I don't care.

You know driving tired/sleepy has been proven to be just as bad as driving drunk. I wonder how many of us have driven tired or sleepy? I know for a fact I have although I try not to after reading that study.

Both are absolutely voluntary activities with all the "intent" being the same, why do you think they are punished vastly differently?
