Some states still have sodomy laws, which is utterly ridiculous and should never be used. But I'd say if she's providing alcohol to a 13-year-old and then having sex with him she should still be charged with the other things she was charged with.

I found out when I studied the Uniform Code of Military Justice.

It is unnatural carnal copulation for a person to take into that person?s mouth or anus the sexual organ of another person or of an animal; or to place that person?s sexual organ in the mouth or anus of another person or of an animal; or to have carnal copulation in any opening of the body, except the sexual parts, with another person; or to have carnal copulation with an animal.

Pretty outrageous that plain old oral sex is equated to sheep-poking. And it doesn't have to be rape, even if it's consensual it's still sodomy.
