If you are in an accident with a driver who doesn't have insurance, and the accident is that person's fault, uninsured motorist coverage on your insurance policy provides payment for injuries sustained by you and your passengers and for the damage to your vehicle. Types of uninsured motorist coverage cover bodily injuries and property damage. California doesn't require you to purchase uninsured motorist coverage, but insurance companies must offer it. The minimum limit for uninsured motorist bodily injury is $15,000 per person with a $30,000 aggregate limit per accident as of 2011. The minimum uninsured motorist property damage limit is $3,500 per accident.

the problem is Nancy did not purchase uninsured ins from her auto ins.

the guy that started the chain reaction accident does not have auto ins at all; and nancy does not carry uninsured motorists ins as well, so she is basically screwed front and back both the the uninsure motorist, and her ins company as well.

Well, thats the risk one runs when you only get liability insurance. Maybe it would have been worth it to get full coverage in hindsight, eh?

No insurance doesn't mean no money. It may not be enough for the lawyer who dropped her, but she may be able to find one who will do it. Especially if the other drivers give up.

Any lawyer would take the case but since there is no payout from an ins. company SHE will have to pay the lawyer out of her own pocket and hope some deadbeat makes good on a judgment, good luck..

on Dec.7th I was driving on the 5 south freeway. Traffic had been a little slow for about 45 min, when it finally came to a complete stop. I had my foot on the break while I waited with some distance in front of me. Out of nowhere I got struck pretty bad from the back. My neck especially slammed against the headrest. I was in immediate shock as I was bawling I tried calling my boyfriend to tell me what to do next. I was disoriented and my head was throbbing. To my surprise as I got out of. the car here where 4 of us in the accident. Some guy rear ended the lady behind me which then caused her to rear end me. Now since I had been stepping on my breaks I guess I didn't get pushed into the next car. But the nightmare doesn't end there. The force of the impact caused the lady to get pushed of to the left and she ended striking the car directly to my left.

Being my fiirst accident I didn't know what to do? I didn't get to get anyones names or info. It all happened to fast. The highway patrol arrived asking questions. Regarding the accident, the next thing I know I get my keys taken away along with my registration, proof of insurance, and my license as I'm being taken by the ambulance! As I'm waiting to get a cat scan the officer on the scene comes into the room with my license and tells me my car has been towed asks me a couple more questions. Then leaves.

The only thing that helped me is that the lady that hit me got taken to the the hospital In the same ambulance! I overheard her name and that she had AAA. I only got my vitals taken and the cat scan done but when the results came that my neck wasn't broken they
discharged me and gave me strong pain killers. Norcos. From the time of the accident at 6pm to when I got discharged at 10pm I immediately called to get my car out but the lady sai I couldn't get it out until Monday.! The last I wanted to do was argue so I just hung up. I filed a claim on sunday. Without my car to go to work I didn't work momday and Tuesday. They said I was taking time from my vacation! Yeah right, it was a nightmare!!my insurance pretty much wasn't moving a finger to help me since I only obviously. Only had liability. To my old 97 nissan altima. On the other hand, the lady behing me had a 2012 ford fiesta hint: full coverage.

Long story short, by Monday my towing fee was $785. And no way I can pay that! They kept on telling me that I need tp get it out because I'm going to be held responsible. If I go over the limit from what the guy can pay. Confused and pissed that I had to keep paying out of poket I decided getting a lawyer. Finally some relief he sent me to a chiropractors to start treatments. It started making me feel better but as of yesterday. December. 17th he said there is no case anymore! We were all going after the guy that started the crash.. that asshole didn't have insurance!!!

Now I have the hospital bill, chiro bill, car is totalled, and my towing bill is still piling up!! Now it must me up to 2,000!! Is so pissed and stressed. He did mention I could sue but if he can't afford his $20 a month insurance he is dead broke!! And that if I try suing the lady that hit me they WILL fight me and I most likely will lose!! What can I do??? I didn't hit anyone why do I have to pay??? Please help me.

what done is done, accident already happened; Nancy is asking for help; the accident w/o carrying uninsured motorist ins will be a very expensive lesson on her part, and now she is asking the AT community for her;

if she post picture of herself, maybe the AT members will be more willing to give advices; i know there are a few lawyers on here.

OP, link to police report about accident?

(Til then, I'm skeptical. New account... I'm not saying you're a troll, but there are a lot of people scamming people for donations regarding the recent shooting.)
I'm still waiting for the police report. As of yesterday it wasn't ready yet. But I did get the face page.

Yeah, I had never been in an accident before. Never knew what uim or collision coverage meant till now. I just would hate to see that asshole get away with it.

Why didn't anybody teach you?

Anyway, always have underinsured motorist coverage on your own policy.

An umbrella policy isn't a bad idea either, if you can afford it.

But anyway, they may very well get away with it. Being too poor to sue is actually a pretty good defense mechanism in this legal system. Oh sure, you might be able to get his wages garnished or something, but if he had income worth taking, he'd have had insurance - are you sticking it to him, or the three kids who rely on his Taco Bell paycheck?

Do you have health insurance? If so the health insurance should pay for your medical bills, and will provide you with a lawyer for a lawsuit.

The health insurance should send you something to fill out to describe the accident, how the injuries happen, and who is liable for your injuries. They will then take this in file a lawsuit against the party that caused it on your behalf.

The guy who caused the wreck caused the wreck.

The lady who hit you was probably traveling too close behind you. Otherwise, when she got hit, she may not have struck you.

Small claims count, no lawsmith since you likely won't collect much.

Also, get better insurance. Even if you have an old car and cant afford "full coverage" make sure you have "uninsured driver" and "medical" coverage....

Yeah I do have health insurance but I hadn't. Even told them about the accident yet.. the lawyer said to send him the papers and he would deal with it. But I don't think he did, I got a letter from the hospital yesterday stating something about "self pay". Ill call today to see what's going on.

Well first off.. I searched online for similar accidents like mine and this forum came up with. I signed up and posted my situation. Lol, just noticed I posted it under tech.

And when he just posted "i5-something" I thought it was a form to fill up.

Ok . I guess I should have followed the post more closely . Uninsured motorist more dead heads who screw people up with their mistakes and and never pay the price . god the number of low lifes in the world is unbelieveable. You have money for a car gas . BUY the dang insurance . Lowlifes

Starting in 2006 in CA, you need to provide proof of insurance to register a vehicle. The DMV gets notified within 45 days of insurance getting dropped.

if the person doesn't have insurance, they are personally liable. Your insurance company is going to handle things. It takes a lot of phone calls and patience to get things like this resolved.

Until you have the police report you are in limbo since your insurance company is going to need that to proceed.
Your insurance company will be mailing you numerous documents clearly explaining what they are doing and why. Everything will be in writing.


Oh and going after the lady that hit you.......not going to happen. If the police report shows that the initial car that started the accident was the sole cause of the accident, the other parties involved are going to be indemnified. Since you were at a complete stop there won't be an argument that the person behind you was too close. You don't leave 8-15 foot distances between stopped vehicles.

I wouldn't value any American car above $50.
