to the OP, get a lawyer, and get an under insured/uninsured rider on your policy.

The lady that hit you can be partially at fault due to following to closely. Even if she was stopped; the fact that she hit you become an issue. Her limits will be her liability.

Her insurance company will fight it because they know that if they pay you; they can not get anything from the the guy that caused the accident.

You jsut have to keep searching for a lawyer and provide them with all the paperwork that you have available; hoping that one will see some $$ and take the case on contingency.

I love to watch these arguments get thrown out. There is reasonable distance sure, but have you seen what a 6,000lb SUV can do even at 20mph? My Expedition can DRAG a car with its brakes locked, 20mph momentum? It'll send the car down range like a billiard ball. Especially when people tend to let off the brake when they get hit and their car is in drive.

We were rear-ended rather badly by one of their insureds in 02/2011 - he admitted 100% at fault.

We had 4 car seats in the car at the time and we wanted them all replaced - 3 Britax and 1 less expensive model. They wouldn't pay full replacement cost without original receipts even though we were going to turn in the seats to them.

Nice of you to throw another victim from the accident under the bus. She is injured too but you want to stress her out and make her pay for a lawyer just because the original person who caused the accident does not have insurance.

Depending on the state everyone in the chain reaction except the last person could be partially liable.

Did you not have uninsured motorist coverage? I always carry that even with liability. It's only like $5/mo with a shit driving record, "high performance" car and under 25. If you waived that, then I dunno. Good luck.

In Ohio, on my last accident of 15 years ago, I was found at fault because I hit the other car from behind.

Now this car I hit was in the right turning lane on a 55 MPH causeway, and pulled into the through lane and stopped, even though the light was green, and I simply had no way to slow down quick enough - never expected a car in a turn lane to enter my lane and stop on a green light.

The idiot didn't know where he was, and thought he needed the other lane, and was undecided on where to go next ...
Even with him admitting what he did, I was at fault automatically because I hit him from behind.

See if your state has similar laws, and you can sue the lady that actually hit you, regardless if she was the cause of the accident or not.

This is an example of why poor people don't need insurance. If they cause an accident, they have no money to pay if they get sued. And they will not go to prison for driving without insurance and causing an accident even if it's against the law. If they do a hit and run, they will just spend a night in jail.

Your best bet is to hire a hit man to kill his family to teach him a lesson.

this is one of the reasons why it is good to be an illegal mexican

CA doesn't, or at least didn't last time I was shopping for insurance. I know cause they asked me if I wanted it. For the small amount extra and living in illegal haven CA though, it would be extremely unwise to pass on it. Assuming it actually does anything if you need to use it, and insurance companies don't just cite some exception for denying your claim as usual.
