Did you perform any field sobriety tests or have your blood drawn at the station? What evidence do they have you were intoxicated?

I know I am coming in at the end of this but I do have plenty of experience with DUI's.

You CAN get a DUI on any type of a vehicle. Animals included.
If you refused the breathalyzer and no blood/breath/urine were taken, then you more than likely are just being charged with refusing a PBT. For a DUI they have to have a BAC.

Get a lawyer NOW. Not court appointed. Its going to cost you at least $1500 but it will save you a ton of money in the future. You can ask on the forums all you want but the reality is that most of the people replying are not going to be from your state and also have never been through the court system. Stop posting and get a lawyer.

EDIT: Saw you did take a PBT. Even more reason to get a lawyer, NOW.

Yea I failed the field sobriety test but refused a breathalyzer...

As I had posted earlier, in Maryland refusal of a breathalyzer is/can be considered admission of guilt.

You are guilty of refusing a breathalyzer, not DUI.

don't ask here. get a lawyer. a good lawyer can get anyone out of just about anything. you have a very good chance with this.

DWI on a bicycle.....I do wonder if you can get arrested for walking while intoxicated. How about falling out of a chair after a couple of beers, sitting while intoxicated?

Its good that you refused the breathalyzer. Now you are gonna need a good lawyer, look to spend at least $2,500 bucks pre-trial for one. I think it is total BS that you got a DWI on a bicycle though, fuckin pigs.

Why not? The punishment is the same so I'd take the car simply because it is more convenient.
