I need to get control of a domain name from the current registrant.

A retailer that doesnt seem to be trading and was only a one outlet business is pretty uncontactable, and has a domain name I want for my fledgling business. It is avnetworks.com if you do a whois for av-networks.com you will see the details. I intend to Trade Mark the name of the product line (AV Networks) and to use the website, as it is associated to the name of my product line. This registrant isn't using it and admin control for av-networks.com is with his old ISP, and avnetwork.com with a brokerage asking a min of 700usd. How can I force this person to hand the domain name control over for little or no money? Please help.

I don't think you will be able to force the owner to give it to you.

You are probably out of luck, they own it legally, and know it is worth something, so you trademarking the name after the fact and trying to get it from them for free really doesn't sound like it would fly.

If this person owned the domain name before you acquired your trademark, I doubt that you can "force" him to do anything. Nor do I think you should be able to do so. Make an offer. Negotiate.

there is no way i am paying more then the cost to register for the domain name. Ill try and use trademark law and make his defence/ time cost him more than its worth, it if he doesnt hand it over.

Someone took the name i wanted (aphex.net) for a freakin search portal... Assmongers... Theres nothing i can do though...

so if atandt own the only telephone exchange that you can access and just say we wont connect you is that ok?

well this guy isnt leveraging money out of me for nothing. cybersquatting is despicable, and Im not going to tolerate putting money into a name/ brand recognition only to have that investment ameliorated by this guy.

well when VISA went to register in australia they found the vomiting infant sickness association, which was a squat site, and wasnt a business, anyway defunt businesses cant claim any business interest in the name, he isnt even paying for hosting.

you have a business aphex dont you? its a shame that local businesses cant use local domain endings, because like I said this was just a one shop business I think.

I have emailed him, but his information is out of date as well. If he want more than 100usd then ill force him into court and maybe he will say ok, because I cant see that he could win.

You have zero understanding of the law. You have absolutely no rights to the domain, zero, nada, none. Not only that but your already telling us how you going to go bully the guy over $600. Your a joke.

Those who file frivolous lawsuits are often held accountable for the costs of same. If you intend to proceed with this, I suggest that you seek the advice of an attorney, not a geek forum like this one.

rbhawcroft. i find your attitude more despicable than "Cybersquatting". first of all, the owners here aren't cybersquatting. they actually were at one point trying to run a business. they didn't do it knowing that you were going to trademark the name (it's not like registering ford.com or GM.com, a well known name.

also as far as he's concerned he's marketed the name for his product and you are going to benefit from that marketing. HE has every right to try and sell it on the open market, the fact that you invested money on your little product line w/o doing your DUE DILIGENCE first does not give you the right to bully him.

well cheers. you could see it that he is a squatter and using the fact that he has the domain name to force money out of me, and anyway you dont own a domain name you rent the right for it to reference your web site, and he isnt using it.
