I was given a Speeding Ticket last night for doing nothing. *CONCLUDED*

Last night I was sitting in a parking lot with about 10 other motorcycles.. I had been siting there for about 20-30 mins just chatting with the guys. 5 of us decide it was time to leave and go do some riding.

RIGHT when I started up my bike, 5 cop cars were coming tward us, I turned on my signal and exited the parking lot. I was going MAYBE 10mph when he turned on his lights and pulled me over. I IMMEDIATELY pulled over and shut off my bike. He came up to me and asked me for my license.

He was gone quite awhile and came back and asked me for my insurance. I got in my bikes trunk and gave it too him, unfortuneatly the CARD was expired, and I tried to explain to him that I am fully insured, with the same place, same policy number.. So he went back to his car for another 20mins.

Then ANOTHER cop car came up. And then ANOTHER. I had THREE cop cars behind me.

After about 20 more mins or so, he comes back and hands me a ticket. FOR GENERAL SPEEDING. I ask him, "A ticket for speeding? I didnt go over 10mph" he tells me:

"I know you have sped sometime tonight... You are on a sportbike so I know that you have. This is a ticket for speeding"

I was like WTF. Sir, I was NOT speeding, I was sitting in a parking lot, and decided it was time to GO HOME. He started to get more "dickish" telling me that I should be happy that he wasnt towing my bike and not going to jail!

I told him: Seriously officer, I have not been doing ANYTHING wrong, and I know why you pulled me over... You pulled in behind me and turned on your lights to see if I would run. I tried being the good guy and stopped. (my buddies of course ran and got away) I then said, this is harrassment, I WAS NOT SPEEDING, you cant give me a ticket for speeding. Are you filming this?

He then said (with a smirk): Nope, we are not filming this, we will see you in court.

WTF. At this point I was pissed. I told him that I have several friends that are lawyers, and that I will be calling the city and filing a complaint. He then called over another officer and the other officer told me that if I dont sign the ticket IMMEDIATELY, they are towing my bike and I was getting a free night in the city jail. (KCK btw -- not exactly where I wanted to go)

So I said a few words about how proud I was of them protecting the "community" from the evil motorcycle guy who was going motherfvcking 10mph and signed the god damn motherfcuking ticket.

NOW I AM PISSED. I want to go to court and get this guy fired.



I am looking for some GTA graphics or something so I can explain exactly what happened. I cant find them on google.. I am looking for GTA2 Sprites of the Motorcycle and the Cop car.. I had a very bad night last night (got pulled over and ticketed for doing NOTHING other than riding a motorcycle) and I want to make a graphic showing what happened..

so pissed right now arrgh! Thanks if anyone can help me

UPDATE 9/29
Update:

Court was at 1pm Central today.. I got there and found that there were two courtrooms A-L in room A, and M-Z in room 2. I head to room two. I sit there while the judge gives his little speach.. Then I hear this:

"Those of you who are here for the first time for this specific incident, will approach me and either Plead guilty and pay the fine, or ask for trial. I will then give you another court date"

WTF.

So I go up there and show him my proof of insurance, he tells me "I dismiss the charge of no proof of insurance" and then he asks me what I wanted to do on the speeding. I tell him: I would like to request a trial. I then tell him, to be honest sir, this ticket is absurd -- I was going 10mph and he gave me a driving to fast for conditions ticket, "Is there any way to get this thrown out".. Well apparently that didnt please him, lol.

He told me that is what my trial is for, to hear both sides of the story. He then gave me the choice of these two dates: Sept 30th & Oct 7th for my trial. Well considering my wife is due on Sept 22nd, I had to take the 7th.

ARRRGh What a waste of tax dollars.

Update 10/12
Ok, so I finally get to log back into AT and I find that I have 50 trillion pm's asking me to update the thread.. So here we go. (you will not f'ing belive this)

So I show up to court on 10/7 as scheduled previously, as I walk into the courtroom I notice that there is only about 6-7 people in there, and I think to myself -- sweet this should go quickly.

The judge asks us to line up again, I just so happened to be the first in line. He calls me up and asks if I am ready for trial. I acknowledge that I am, and he requests that I sit back down. I wait about 15 minutes for the others to go through line, and then the prosecutor calls me up.

I walk up to him, he has a very arrogant aire around him and he looks me in the eyes and says: "Bill, normally on these types of tickets we don't take it to the second court date, we normally just adjust them and you can pay double on your first appearance so that you don't have to come back and it wont be on your record. I would like to offer you the same deal, I can adjust it to a Jaywalking offense which carries an $80 fine so $80x2 + $30 court costs comes to $190."

WTF. I told him "I appreciate the offer sir, however I would like my trial. I was given this ticket unjustly and I would like it dropped. I was NOT speeding, and the officer gave me a ticket indicating that I was".

He then responds "Whatever, I have spoken with the officer and he told me that he DID witness you speeding."

I then replied: "That is interesting, I would like to speak with him in court" He then tells me to sit down.

I watch as the prosecutor goes over to a group of police officers (Which I had previoulsy checked out; the first officer is not in the group, however the second officer is there.) The Prosecutor tells him, "He would like to go to trial, can you please call him"

OMG... The officer isn't here and they are going to CALL HIM to come to court. I sat in on my bench just fuming. What a crock of sh!t. He knows he is in the wrong so he doesnt even give me the decency of showing up to court to defend his actions... Oh well, I think to myself, if he doesnt show up the judge will just drop the ticket.

The judge takes care of a few other people and then retires to his chambers for a small period of time (~20mins)

When he comes back he calls me up to the bench. The officer has not shown up, so I am in the clear. I really didnt want to win this way, I wanted the judge to let the officer have it, but hey I will take it any way I can get it.

I approach, and he tells me

"The officer that issued the ticket is unable to make court today. His superior officer Huang (second officer on scene) is here, but he is unable to discuss the matters of that night since he was not the officer that issued the ticket. I, along with Judge XXXX (some other judge) both feel that BOTH sides should get the opportunity to state their side of the story, so I am issuing a continuance on this matter."

I said to the judge: "Sir, this is my second time in court on this matter, the continuance will make it three. I have to leave work in order to make these court dates, for a ticket that I didnt deserve. Sir, was NOT speeding -- I was sitting in a parking lot and was issued this ticket. Since Officer Huang is here, can we please go through trial and resolve this?"

The judge responded: "Bill, as I stated both parties needs to be able to state their side, since this is an inconvience for you, you can pick out the date that you would like to return, as long as it fits with the officer's schedule. Officer Huang, as the senior officer on this matter, your normal court date is Wed correct? (correct) Ok Bill, what Wed would you like to do this on? (I tell him the first wed possible is fine) Ok, we will reconveine on Nov. 9th (fixed for good). If the state is not prepared this time Bill, I will dismiss the ticket, have a good day"

:|:disgust::Q:shocked::thumbsdown: There is no emoticon for how pissed I am.

On my way out I call my lawyer and she tells me, "Man they are really sticking it to you. Not only with the date but adjusting it to Jaywalking? It should be adjusted to a parking ticket if anything"

and on and on and on...

I am pretty much to the point that I am thinking of calling my congressman or the govenor or something. This is insanity.

There, there is your update. Arrgh.... Now I am mad again.

Conclusion
As I prepared for my day in court, I thought about all the different scenarios that they could possibly throw my way. From all of your comments I just KNEW that the officer would more than likely get on the stand and tell the court a false scenario. Would that say they saw me speeding? Would they say they saw me doing a burnout or a wheelie? I prepared a list of questions to ask the officer -- to help prove my case against any scenario I could dream up they would come at me with. However, I had not prepared for what they were going to do today.

As I sat in court, looking around I recognized several people from my past appearances. The cashier lady, the Bailiff, and finally the judge.

OH SH!T. There is the officer that ticketed me. Standing next to him is his superior officer that I spoke to last time I was in this court. Apparently they were not going to let me off easy by not showing up this final time.

I could see them talking to each other and scanning the audience, Attempting to locate me I thought to myself. As they continued looking though the crowd, we finally made eye contact. The superior officer waved hello, and then pointing outside the courtroom "asked" if I would be willing to step outside. I of course acknowledged, and as we met in the hallway both officers extended a handshake.

They then told me:
Bill, the reason why we pulled you over was because the area you were in is a known spot for road racing. When you decided to leave the scene as we pulled up, you drew suspicion upon yourself. To this I replied: Sir, I understand the area and your position, however you need to understand mine -- I never did anything wrong, and this is my third court appearance trying to prove it. They responded with the unthinkable.

"We have discussed this, and would like to DISMISS the ticket provided that you quit road racing at that area. I then told them that I appreciated the offer, and that they would never see me there again. Our conversation continued, I apologised for losing my temper that night, and they apologised for not showing up last month. We talked about wasted resources and finally they said they would speak with the DA to get it dropped.

As I went back to the court room I was in shell shock. I had prepared for a battle of lies, and in the end honesty and justice prevailed. The officer talked with the DA who then called to me. The DA then (very DICKISHLY mind you) told me: The officers have decided to drop the charge, however I think it should stand but it isn't my call. Before I sign this, you do of course understand what will happen if we catch you at (the area) again, RIGHT? not wanting to argue anymore, I said yes.. I just wanted out of there. He signed the dismissal and I was out of there, scott free and happy.

WINNAR!

I was going 0. He gave me a ticket and said "I know you have been speeding sometime tonight" so here is a "general speeding" ticket.

I am serious. That really happened to me last night. I tried to argue with him and he told me that if I continue I was going to jail. I can either take the ticket, or go to jail.
 

"No valid proof of insurance" is a perfectly acceptable reason to write a citation in my state. But the speeding violation sounds sketchy.

Take it to court, call ALL of your friends that saw it. Call your insurance company and get a new card, or something else that proves you're insured.

well if you dont live in a state that is setup to solely to take your money you can plead not guilty and request a trial by jury.

Yes, the insurance ticket is no biggie, that was my mistake. But a speeding ticket because he is pretty sure that I was speeding at least sometime last night? bullsh!t

Unbelievable. I hope to God you are fighting this ticket.

Even if you can't afford a lawyer, you can still file for discovery and try to pin the cop in court about how he measured your speed.
