Identity Theft - How easy is it to do this?

Not too long ago, my wife was victimized by a couple of scammers at a local grocery store. One guy distracted her while another snatched her wallet out of the diaper bag. We found out approximately four hours after the crime by a phone call from our bank. They let us know that someone was buying gasoline on our debit card for the entire population of Detroit. Our local police informed us that this happens all the time at our grocery store, and that they weren't doing anything to protect the taxpaying citizens who were too stupid to look out for themselves. Obviously, there is no revenue to be collected by doing sting operations or the like.

I was pretty outraged by this. But what really got to me was the fact there was no one to sue. There was no way to get back at whoever did this to us.

Fast forward to the day after Christmas. My brother-in-law realizes his credit card is missing. After a little detective work, he finds out that the cashier at a local restaurant never gave him his card back and instead, pocketed it. They have her on camera doing this. She proceeded to assault their credit with the help of some people with whom she shared the information. He and my sister go to the police who, after some more checking around, discover that some people who work for the contract cleaning crew at her work had gotten her information and had assumed her identity in applying for more credit cards.

Please, someone in the know tell me my sister can sue the restaurant and cleaning company. And, when are things going to drastically change to counter the ease with which identity theft can occur?

If you're an employer and you have an unscrupulous employee with no prior record, how would you feel if you were sued for something they did. It's unfortunate that your family was the victim but it's up to you to protect yourself.

So...he paid with his credit card and didn't get it back so he just left??

He was careless. It didn't register with him at that moment what had occured.

is he liable for any of the purchases that were made with that card?

if not why does he want to sue?

For your wife in the Grocery store theres not much you could have done except to call & cancel all CC's as soon as you knew the wallet was stolen, but your sister should have made sure she got her card back ... this doesn't garantee you won't get "double-swiped" & get you card number stolen that way, but at least it keeps the actual card out of the bad guys hands.

credit card alone can't be identity theft. they will also need at least your SS# to do anything further.

I agree in his case. My sister's situation wasn't her fault. An after hours cleaning crew rifling through personal information was out of her hands.

Yet, they got it somehow. Which is why I asked how easy it is to acquire personal information and assume someone's identity.

If I get the VIN off of your car I can pull down a TON of info...including SS#.

Are you serious?

Yes very serious. Now..I couldn't do it all myself, but I could do a major portion of it online and because of the freedom of information act. It would require one to have some contacts in certain areas, but nothing too difficult....especially for these people that do it all the time.
