If I point a gun at someone and they have a heartattack, is it considered murder?

That's not enough info. Was there just cause for lethal force? If so then it's a justifiable homicide and not a crime. Otherwise I'd guess you're looking at some form of manslaughter.

It would be impossible to prove that you were directly responsible for the heart attack. It coulda just been that guys time to go.

Hey. Don't be stereotypical. I eat healthy, work out every day, but have rapid pulse and high blood pressure. This in itself (even though i take meds!) COULD cause me to have a heart attack. But where did I go wrong?

Oh, and don't mention ANYTHING about me being in bed with another women, sex, not making moves, etc.

One thing I've never understood...why is suicide illegal? If you succeed in commiting the crime, what are they going to do to you?

Doesn't matter. You'd lose the civil suit and have to rob a bank to pay the bills and then you'd go to jail for that.

Anyway, back on topic. I would think the offender would be charged with manslaughter, not to mention brandishing(sp?) a weapon. Because someone is actually pointing the gun though, I don't think they would get off on involuntary manslaughter.

i think it all brings it down to what the intent of pointing at the gun at the person was, if you were Jack Bauer constantly saving the world and you pointed a gun at a guy just so he can go to the safe deposit box to implicate the President of the USA in the assassination of a former president, then i guess its alright, even if he dropped dead because he was too scared and too fat.

Manslaughter, plus some other charges, like conspiracy to commit murder.

If you let the person die, while they are having a heart attack, and they prove it, you could get murder though.

**EDIT**
But this second part is hard to prove beyond a shadow of a doubt.

You pull a gun on a person and they run, they start to wheeze and have a heart attack but run into traffic and get hit by a car that flips trying to keep from hitting him, spilling gas everywhere and igniting. The extreme heat and smoke smothers the man's lungs, and he dies. Do you still get murder?

no. if this happened in new york, here's what would happen:
the guy driving the car could get negligent assault?
and the maker of the auto can get sued?
also, gas company get sued for selling flammable liquid?
and the EMTs on the scene also get sued for slow arrival.
but the person with the gun, no charges filed.

In NH, that's murder one. You did a crime and the person died.

You can actually get five murder ones out of one killing, here. One for murder, one for theft, one for kidnapping, one for rape, and one other that I can't remember.

From what I recall from law school (or Law & Order or NYPD Blue), felony murder is when someone dies during the commission of a felony. So, in the case in the subject, someone died during the course of an assault with a deadly weapon. That's most certainly felony murder, assuming the state jurisdiction in question has that definition.
