They would take around 40+% unless you have some great lawyers.
It all depends on the WILL of the deceased really.
It can vary greatly...

40 Billion? shoot i'd buy US Treasuries, retire and live off the interest. also not pay any income taxes on the 40 bill also.

I'd keep 200 million for myself and set up a phylanthropic instituion with the rest. The third world needs a LOT of help and we all know that food shipments only stop starvation (and rarely even that).

I would take a year off to travel around, learn new things and enjoy life.

Then I'll save up enough money to pay for my living for the rest of my life, and just study, work and relax doing things I love. Perhaps invest a little or start a new company if I see some good opportunities.

Let me put a bit of perspective on that amount of money. Let's say you bankrolled the whole wad into an income producing investment earning, say, 5%. Every single day for the rest of eternity, with just the earnings, you would be able to buy another brand new $5 million dollar house, and still have over half a million left over to furnish it with.

Paying for your living for the rest of your life? I don't think you'd possibly be able to spend $40 billion in your lifetime if you tried, short of buying an entire corporation, or a country.

I'd put in an interest bearing account. Why not? I'm obviously not going to spend it all at once, so it would make sense to rack up some more while it's lying around. Besides that, I'd buy a sports team, lower ticket prices to a max of $10 for the best seats, and then tell everyone to go wild. No suits in my arena. If you've got a cell phone, no admission allowed.
