For a personal site, I'd get the .net. For something where you're relying on attracting visitors - ie. business - you really need to come up with a unique name, and preferably register both the .com and the .net.

Yes, sortof, but as someone else said its not enforced. .com implies a company, so why even worry about it? .org is organization, theres tons of others
