Mostly it gives Police just cause to stop and question any minors they see out and about. In the town I grew up in - many decades ago when police actually paid attention - they definitely would stop you for being out. It was a small enough town, though, that I didn't get a ticket. Rather, the nice officer told me to go home... and had the dispacher call my house to tell my Father to expect me.

Hand it to your insurance provider,... then expect your rates to go up a certain %.

The lawyer of the girl figured you may just pay $4K and not have to worry about all the red tape and the possibility of your rates going up.

Its like patent trolls sueing small companies who don't have an army of lawyer to scare said trolls away, so they settle for some small 4 digit figure.

july 09 I got in a car accident... I was coming up to a red light, one car waiting at light. it turned green, car started going (foot off brake) and then stopped again in the intersection and I rear-ended the girl

called the cops then went and checked damage.

her bumper fell off

my car was almost undamaged (two nonfunctioning fog lights popped out of socket, that's it)

cops arrived, took a report, and then we all drove away (she put bumper into backseat of car)

then, a week or two later, I was standing out front of my girlfriend's house late at night with her and a cop drives up to us. Asks if we are over 18 (we both were). I show him my license and he goes "hey I know you". It was the same cop from the accident. He starts talking about the accident and how it was suspicious. He thought that maybe the girl had been drinking (11 pm. wearing a skimpy dress. didn't get out of car once even to check damage. didn't say much)

just today I received a letter saying I was being sued for $4000 from that accident



I thought insurance covered all of this (we have very good coverage)?

I think I'll drive to the police department tomorrow and get a copy of the police report

Do you live in a small town or something? What are the odds of you bumping into the same cop like that?

Any time you rear end someone it's always your fault in the eyes of the law/insurance companies.

I would bet your state has a 2 year statute of limitations on personal injury. For the last two years the other driver has had medical attention and her attorney was talking to your insurance adjuster trying to get the claim settled.

With the filing deadline drawing closer and not having a resolution; the other attorney filed to preserve the claim. At this point I would bet your insurance already knows you are being sued; if not call them. They will provide you an attorney. You will have to answer interrogatories and be deposed but beyond that you don't have much to worry about.
