I wonder how far that excuse would go on an audit.
My spreadsheet and scanned images of receipts over past 3 Years were lost

Backups were on my 5" floppy along with drivers needed for my XP system. Which Microsoft no longer supports.

Nice attempted dodge. With a grant of immunity, it's very much in Lerner's interest to tell the truth, expose any conspiracy that might have existed. *Might have existed* being the operative phrase. If Repubs are so sure there was one, then they shouldn't pass up this opportunity.

She's retired, out of govt, and the only cloud hanging over her head is this imbroglio. Granted immunity, she has every reason to tell the truth, whatever it is, and to be free of this once & for all.

Repubs don't want to know the truth- they just want mud to sling.

This is the scandal that offends me the most, and hearing the Imperial President decree that he has a phone and a pen, in offense of the Constitution. Our Federal government has enumerated powers, we are living in a post-constitutional age.
Obama has to be removed from office. A shockwave needs to be sent through the federal government from top to bottom.

The IRS said technicians went to great lengths trying to recover data from Lerner's computer in 2011. In emails provided by the IRS, technicians said they sent the computer to a forensic lab run by the agency's criminal investigations unit. But to no avail.

The IRS was able to generate 24,000 Lerner emails from the 2009 to 2011 because Lerner had copied in other IRS employees. The agency said it pieced together the emails from the computers of 82 other IRS employees.

But an untold number are gone. Camp's office said the missing emails are mainly ones to and from people outside the IRS, "such as the White House, Treasury, Department of Justice, FEC, or Democrat offices."


What a coincidence.

What a magnificent contrivance from Camp's office. Reminds me of Joe McCarthy's lists of communists.

You don't trust the IRS, but you do trust the partisans who have the power to further the investigation but refuse to do so. So figure it out- why do they refuse Lerner immunity to gain her testimony? What is their purpose?

I'd say it's beyond the sentiment of nice. It's essential. It's both parties, it's the system they have created to benefit themselves that needs to be rocked right down to its core. There needs to be some fear put back into the equation.

There is no way this is true. I deal with the email & collaboration catalogue at a very large IT company and we cannot offer email services without real time archiving for any government contract.

The Federal government uses Microsoft Exchange at every department and agency I am aware of.

How were the emails even on her computer? They should be stored on the Exchange server and retained according to its retention settings.

IRS Rules Say Lerner Was Required to Keep Printed Copies of Those Supposedly ‘Lost’ Emails

But even if the IRS is telling the truth about the computer crash, its own employee procedures indicate that Lerner should have paper copies of all her emails on file.

The IRS maintains an Internal Revenue Manual, and chapter 10, section 3 of that manual deals with standards for using email. Those standards, which apply to “all IRS employees,” make it clear that paper copies of all emails must be maintained.

Section 3 states that, “All federal employees and federal contractors are required by law to preserve records containing adequate and proper documentation of the organization, functions, policies, decisions, procedures, and essential transactions of the agency.”

“If you create or receive email messages during the course of your daily work, you are responsible for ensuring that you manage them properly,” it adds. “The Treasury Department’s current email policy requires emails and attachments that meet the definition of a federal record be added to the organization’s files by printing them (including the essential transmission data) and filing them with related paper records.”

According to these guidelines, an email formally becomes a federal record very easily. It just has to be created or received in the course of IRS business, is appropriate to keep as evidence of the government’s activities, or must otherwise be valuable based on the information it contains.

Section 3 also stresses that maintaining email records in a computer’s email application “does not meet the requirements of maintaining an official record.”
