Well, depends if the other guy wants to press charges. I suspect that if neither of you presses charges, nobody else can, but if you break any thing the owner can, and if one person wants to call it assault, it is.
In my city if 2 or more persons are fighting the police will file the charges under what they call assualt by mutual consent. Dont laugh it is the law here.
Public fighting (anywhere that is in town and outdoors basically), the cops can and will hand out $400 tickets to each individual. I have witnessed many public fights in town where the individuals received such tickets. Lately, however, people have been organizing outside of the city limits. In fact, I witnessed such a fight today. lol. Ohh how boring it is here in Oklahoma.
