To me there is no point to owning a gun as the police are right there always. But you other people dont have that luxury.

And its a difference in culture.

My wife and I have friends who own cattle, not very many, maybe a few dozen head each.

When you have dogs chasing your cattle, you do not have time to call the police. You need to grab that rifle behind the door to take care of business yourself.

The county where I live does not have animal control. If I call the police about an aggressive dog, all the police are going to do is shoot the dog.

My family and I are big hunters, I deer hunt, my brother duck hunts, and our dad is an ex-cop. Firearms are part of our family.

Last year my step-daughter had a strange dog show up at her house. The dog was not friendly and was acting strange. The county sheriff did not have time to deal with the dog. I grabbed my 22 rifle went to her house and put the dog down.

My step daughter has 2 small children, a dog shows up that is acting strange, did not have a collar, was not friendly,,, what else am I supposed to do? My step daughter lives in a rural area, its not uncommon to see wild hogs rooting on the side of the road.

In places outside the city we have to take care of our own.

Yeah, she probably should have had him sign a form stating that he did in fact see the gun. For good measure they should probably have gotten it notarized as well. Then she could have shot him.

Lets change the story a bit, lets say this a a botched robbery, the Robbers enters the bed room with a knife thinking its just another room to rob, and see a shot gun pointed at them. Then have the good sense to flee grabbing what ever loot he has already gotten.


And if Mommy then shoots the fleeing robber in the back anyway after the threat of robber's knife deadly force is removed, ole Mommy is going to be facing murder charges in almost every State in the Union. If Mommy gets prosecuted and the Robber indeed got shot in the back, the NRA may ask you for donations, but the NRA will not pay a dime for our Mommy's attorney's.

Which is why I told you, since WE don't know the facts yet, its best to with hold judgment.

I know I know, there by the grace of God go most of us, but when it comes down to using deadly force, best know your legal rights and legal limitations. Ignorance of the law is no excuse.
I own guns too BoberFett, mainly for hunting and not home defense, but gun ownership comes with other responsibilities I take care to educate myself about. I suggest you do the same Bobber before shooting off your mouth before you engage your brain.

I think Mommy is still a little out on a limb legally.

Usually the Mommy has a right to shoot to kill when the intruder threatens here with a knife, but technically until the intruder sees her gun, and is given time to retreat instead of still coming at her, Mommy may have no legal right to use deadly force.

Of course it will depend on the State and circumstances. But the local police are not the deciders, its the local DA's office in her county of residence. And or the DA who has venue here.

I'll reserve judgment here until better facts come in.

Of course the other giant question is, after 21 glacial minutes on the phone with 911, why the local cops can't get a police officer to her house is almost a crime in itself.

Yes it does depend on the state. However, in most states the intruder's act of illegal entry alone creates a strong presumption that the legal occupant was at bodily risk and could use deadly force. According to the information given in the article, this is a legal shoot in virtually every state.

In some pansy state like CA that wouldn't surprise me... but not in a place like OK or TX. There you have the right to defend yourself in your home, as she did.

Just an FYI here, but California has a strong castle law. There is little doubt that the shoot would have been justified in CA. Incidentally, the only states that do not have such laws are:

Idaho, South Dakota, Iowa, Nebraska, New Mexico, Virginia and Vermont. On that list I spot one blue state (Vermont), two purple states (Virginia, NM), and four red states.

For someone that hangs on political forums all day, you're not very well versed on the law.

No, it's actually 43 states if you look at your link more closely. 29 states have castle laws, but 14 have laws that extend the "castle" to essentially everywhere.

If you don't get attacked you "don't need a gun" just like if you don't get in a car accident you "don't need airbags". But you have a right to keep yourself as safe as possible. Self defense is a basic human right, regardless of what the Constitution says.

BTW even in urban areas, police don't just show up immediately like magic. They aren't omnipresent. Ever heard people in poor minority areas talk about how the police are never there to protect them? It's true. You feel safe and think guns are dumb because you probably live in a wealthy white neighborhood with virtually no crime.

My whole point was this thread didnt start out as a gun rights thread excpet for the few sideways comments about how gun control is wrong. I was just pointing out how stupid it is to think that the evil liberals will take ur guns. Its a non issue like abortion used to get people to vote for 1 douche over the other.

It's not a good point at all. In rural areas like where I live, our "local" police station is over 40 minutes away.

In urban areas, the police are so heavily utilized that I've heard of waits approaching 2 hours.

Yes yes, we'd all like to live next to a police station and have unlimited police on duty. Unfortunately for some folks, reality intrudes into their fantasy land on occasion.
