While he is distracted cut the wires of the mosquito and place a spycam near his computer/dvd player from the outside.

Take said recorded videos and drop them off at every soccer moms house.

Here are my suggestions.

The aim is to maximize his annoyance and minimize either proof you are involved or his options to make it stop.

Set up a motion detector spotlight on his side of your house. Put a mobile or anything that moves when the wind blows underneath it. The result is a light that goes on and off all night long and (hopefully) shines right into his windows. He can't really complain about a light you install for security that goes on when the is motion in your yard.

Post a classified ad annoucing a yard sale at his house. Make sure to note that there will be early bird specials at 6am.

Bury some fish in the flower beds near his front and back doors (if he has them).

Spell "666" in his front yard with fertilizer.

Tell your friends to park in front of his house when they come to visit.

You could sue, or get an order for him to take it down on grounds that it lowers your property value since families will not want to buy a house in the area if there kids are harassed by the Mosquito.

Also you can get a resident petition having the whole neighborhood tell him to take it down (a court will rule in your favor).

If you have a neighborhood planning committee, they can tell him to take it down.

If none of that works though, I suggest gasoline and a bat/sledgehammer

Not if it severely causes a public disturbance which it does or severly lowers house value, which it does as well. No family will want to buy a house in the neighborhood if their kids are constantluy tormented.

Well, I certainly feel that way when my neighbors on one side play their rap/hip-hop music too loud, or on the other side, their "La Cucaracha" music too loud, but unless it's between 10 pm and 7 am, the law is on their side.
I seriously doubt there's anything LEGAL the OP can do about the "mosquito", since IF most adults can't hear it, it's not gonna be considered to be a nuisance issue.
