There is no requirement in FL, as in most states, to show photo ID to the police at all. The only mention of having to produce ID in FL is having to identify yourself if questioned by a cop in reference to loitering. (FL statue [SIZE=-1]856.021-Loitering or prowling). Otherwise, outside the usual places/times you need photo ID---driving a car, etc.---showing ID is not required in that state. You don't even need to identify yourself.


According to Florida's statutes, that's not true. You don't need to show photo ID but you do need to identify yourself.

Unless flight by the person or other circumstance makes it impracticable, a law enforcement officer shall, prior to any arrest for an offense under this section, afford the person an opportunity to dispel any alarm or immediate concern which would otherwise be warranted by requesting the person to identify himself or herself and explain his or her presence and conduct. No person shall be convicted of an offense under this section if the law enforcement officer did not comply with this procedure or if it appears at trial that the explanation given by the person is true and, if believed by the officer at the time, would have dispelled the alarm or immediate concern.

The guy in the video was correct; he legally did not have to provide photo ID to the officer. Doesn't make him and less of a douche though.

arguing with the cops always turns out good. people should keep doing that. if you do something wrong, just freaking deal with it like a normal person. trying to be billy badass because you got caught jay walking makes a lot of sense.

also, they tasered the wrong person. that woman has an annoying voice. i almost wonder if this was setup to try and make the police look bad.

the longer i watch the video the more i am sure the person with the camera and the person jaywalking set the whole thing up. i'm guessing they hope for some camera time on the news and some cash for their story. hopefully they just get thrown in jail instead. badgering the police to make a youtube video is a waste of time.

i didn't see that memo, and i don't really want to be tased, so i'm going to sit this one out.

This. The incident was completely unnecessary. When a police asks for ID you provide it. Not doing so will ultimately result in an arrest. These people just want to generate hits on Youtube.

Your point of view is so simplistic. Obviously the guy is irrational for escalating the situation this far and why should the cops put themselves at risk? How do you suggest the cop should have subdued him? They can't just let him walk away.

How about the way they actually had him already subdued? He wasn't go anywhere, and they were in no danger and there were not even signs of danger. It was basically "Give me your ID or I'm going to tase you."

But, if you wanted to be a bit more specific, they could have easily (as they had both his arms behind his back) placed him on the ground and secured him there.

How the fuck did cops ever function without being murdered by every passive resisting man before tasers?

I would only supply ID to the police if I was legally required to. Which in my state would mean they have to suspect me of a crime. So in this case, yes I'd provide ID.

However, The blanket statement you made is against my ethics. I would not provide ID to the police simply because they ask.

2. Cops will use tasers if you attempt to argue with them.

3. While, at times, the police may be in the wrong and you have every legal right to refuse to comply with illegal or unwarranted search or seizure, also realize you are dealing with human beings and their adrenaline is flowing. Be aware that a physical altercation is likely to follow and you will be at an automatic physical and legal disadvantage.

I don't know. Use a gun? This is pathetic. Cops get all this training for hand to hand combat and shooting but they still resort to lame non-lethal weapons. Somewhere out there, Mel Gibson is spinning in his grave.

the problem is in this society the driver would end up in jail or in debt for the rest of his life after he was sued by the family of the idiot who can't cross at the right place.

from the sound of the video he wasn't even going to give the guy a ticket. maybe he wanted to make sure he didn't have any warrants or whatever, or maybe he just wanted to address him by his name. or maybe he just wanted to see his ID. was holding it back worth all of that? i'm guessing no. but as i already said, i think it was a setup from the start anyway.

most people will instinctively try and avoid obstacles on the road, which creates an extremely dangerous situation that can very well end with multiple fatalities.

if there was a guarantee that only the jaywalker would die, then fuck him, but because he can cause the death of the driver or innocent bystanders then measures should be taken against it, ticketting being one of the possibilities.

you see the same thing with animals all the time, deer jumps infront of guys car, guy tries to avoid it, guy loses control of car and hits a tree, guys brain splattered all over windshield.
