I was in a similar situation once. The best thing to do is to work for another company or try switching to another department that isn't run by the same boss and manager.

But if he REALLY likes this job and/or can not get another. Video tape (cell phone) some of the times he is doing his job and the boss lies. It has to be pretty clear no see I did have a pencil type thing. More like he said I did nto do this but here is video of me turning it in to him type thing.
Then go to HR and show them. If they still do nothing file a complint with the state workers commision/Lawyer.

What does he do?

I had a boss like this a few years ago. Our old manager left for a new position, and this guy was hired to take over our group. He, however, wanted his own people and did everything he could to get rid of my three co-workers and I, by throwing us all under the bus at every meeting and review (despite all of us getting good reviews while under our previous manager). All four of us gave him terrible 360 reviews, and yet he remained our manager (just to show you how little HR is worth). We all talked with both HR and the head of the department on numerous occasions, and they all basically acknowledged that things were going poorly and his behavior was not acceptable, but still nothing happened. Eventually, one of my co-workers left, and as we suspected, he hired over one of the guys he used to work with. Eventually, I got laid off, another co-worker left, and the last one transferred internally to a different group, all eventually replaced by people the new guy hand-picked. Not much you can really do if HR and higher-level management doesn't care. Best thing he can do is leave, it's just unfortunate that he has to do it in a less than stellar job market.

This is a perfect example of why to not try and make it work. Take the severance and move on.

I can be rather annoyed with my boss, and tend to have a disagreement in opinion with him from time to time. But generally speaking, we get along very well. And, when push comes to shove from a different department or someone questioning my work, I know 100% that my boss has my back. And he knows that my work is worthwhile to this company.

Not saying every boss to subordinate communication should be just as peachy, but when you have a guy that'll stab you in the back just to keep his shirt clean... better off moving as far from that guy as you can. IE - Different department or different company.

Yea why should he care about his friend. Or his coworker, because you know, the same shit can never be pulled on him.

Most states are a "right to work" state and you can be fired for any reason, at any time, provided you aren't being fired for a reason that is in a protected class (e.g. age if over 40, gender, sexual orientation, religion, race, etc.)

So...your friend's boss could come in and tell him straight up "I don't like you. I want you fired simply because you rub me the wrong way. Yes, you do a great job and will be hard to replace, but fuck off." There is no one he can sue.

This normally doesn't happen because of bad publicity and because company policies (which can be broken) don't allow it...but technically it is legal.

Take severence. Go elsewhere and be appreciated.

When working in the corporate world, there is one thing to remember: there is no "human" in human resources.

The best he can do is counter-offer on the severance package, and perhaps hint about retaining a lawyer if they refuse to budge....then get the hell out. If he has a reasonable counter-offer on the severance, they may take it just to avoid having to pay to litigate.

Thanks for the info. When this blows over i promise I will give more info (except for the company name) and why it's important to me. Right now, there is just too much stuff going on. As of now, he is going to talk to a lawyer the about verbiage in the form.

Things have blown over....

Now I must be completely honest.

This was not only friend, but my gf. Yes, it's a she, not a he. I kind of masked it, because I am sure one of her co workers lurks in these forums because he is constantly saying ATOT quotes when I see him out on the town. That coworker really sucks up to her former boss.

Well, she signed the papers and left. She got 1 months severance, and she found a job 1 week later at Harvard. It turned out good for her. She loves her new job.

That said, my gf has issues with her former boss, but I am urging her to put it behind. Before she left (after she agreed to leave), her boss admitted that the reason why she is pushing her out of her job was because they "constantly butt heads" and it was better for my gf to "just leave". So instead if sitting down and talking about it and giving feedback, she just decided to put her on a plan and make my gf's life a living hell for the past 3 months. FOr 3 months, she lied about my gf's performance, but she was never able to fire her because she was never able to back up her complaints....that is until she got other employees involved with the lies.

To my gf's boss and the majority her dept, who are failed lazy back stabbing business majors, they can go to hell. They wonder why their dept has a turn over rate of close to 80 % (people who leave after a year)...well, maybe if you actually looked at the head of the dept and the people who have been there for more than 2 years, they would see why.

It's a shame that my gf has such a bad view of that company, which will remain nameless due to non-disclosure. The company is awesome, but the business side is full incompetant asses who throw everyone under the bus (as they say, it's accounting's fault that the finance group projected record profits during the awful economy).

I thought about it.....


I can even divulge the details about lust within her dept...

but the NDA was pretty comprehensive and I do not want to her to lose that severance.

You were party to the information before the NDA and did not sign a NDA. So you can do whatever the hell you want.
