I don't see congress passing anyone at this point, so, what happens is, on ties, the lower court decision stands.
I don't think that's going to be acceptable even to Republicans. From what I've heard, most of the circuit appeals courts are pretty liberal. I don't know if that's actually true, but if it is, doing nothing is going to be worse for conservatives that appointing someone who mostly unbiased.

Kennedy, Breyer and Ginsburg are also old so anything could happen during the next term. May be the beginning of a huge swing or a blip on the radar.

It probably won't come to that, stakes are incredibly high. Now that I think about it more if they flat deny anyone and everyone Obama puts up they risk the presidential election that much more. Obama already put 2 in and it only took 2-3 months. He has most of the year to nominate and get votes. Even if they reject his first they would have to drag it out for an eternity to deny a second or third nomination.

Politically speaking this is a lose-lose for republicans. Potentially lose the presidency due to congress blocking nominations, or lose the court by appointing one Obama elects, OR lose both by delaying and getting a democrat as president and still putting a liberal leaning justice in.

They have to be shitting their pants right about now.

If republicans do that I think it would hurt them more. Even a weak candidate like Clinton can beat probably all the front runners on the Republican side now speaks a lot. Let alone if republicans prove they do nothing but vote no to Obama instead of leading.

That and it would just give more power to lower courts. A tie at the SC means the lower courts rulings stands.
In a strange way, I think the GOP is foaming at the mouth to run against Hillary (or Bernie Sanders for that matter). Her hypothetical head-to-head polling against Trump and Ted Cruz looks favorable. But against moderates like the comically newb-ish Marco Rubio, things look more like a coin flip. I wouldn't say it's a foregone conclusion that Hillary beats the eventual GOP nominee. I think Republicans could potentially turn beating her into a strong get out the vote campaign. Not to mention Electoral College math isn't exactly democratic either.

Sad thing is even if GoP wins in November and they're somehow able to cock block the process for a whole year the replacement probably isn't going to be as nutter butters as Scalia was.

And? They aren't going to give Obama the chance if they can avoid it. Even if it's only long shot odds they win in November, they will at least attempt to delay until then I think.

It's February--that seat will be filled by November. recess is what, May or June until September? They'll need a butt in the seat before the election happens.

They would have to put up such a monumental block it would be a cluster fuck for the presidential election. My bet is they realize it'd be suicide to do that and do what they did the last two. Gnash their teeth, wring their hands, cry themselves to sleep at night, but put it to a vote.

The longest any SCOTUS appointment has been drawn out was 120+ days. Obama has like 320+ days left in office. If the GOP obstructs him it will cause them to lose the election. Also Obama is smart and will appoint a slightly liberal leaning moderate to make them look like crap for blocking it. Maybe a woman or latino or black person just to make sure their obstruction kills them in the election.

They cant really stop it. They keep saying they can but its just gonna put Bernie or Hillary in there and then they will appoint the next 2 when Ginsburg and Thomas go.

Then it will be 6 - 3 on the liberal side.

Its time to join the 20th century.

Step 2: Find a legal excuse to rationalize the decision he already made
