There is a down side. Instead of issuing a warning or trying to settle out of court ,now the RIAA will have to file an actual lawsuit against you first (which they have shown an obvious willingness to do).

Yea, but how are they going to find now in order to sue you since ISPs won't be required to disclose that info?

Kazaa Lite KPP is dying out though. No big deal though, programs like eMule and SoulSeek are just picking up the slack.

They would have to file a lawsuit against "John Doe" and then once they create the lawsuit then the ISP must give up the records. This costs them WAY more money and much more time. You CAN still be caught...it just means that it is harder for them to do it and they wont be suing everyone they meet for a while.

It does circumvent the outside negotiations before being sued, but it also means that they will not be suing someone at the drop of a hat anymore. You can still enter negotiations after a lawsuit has been filed, btw. They can choose to drop the suit at any time they choose.

perhaps aritsts should stop making shoddy CDs. there's been like 2 CDs lately that I can just put in and enjoy the whole CD...everything else SUCKS

While it is true that you can still be sued, I am sure RIAA is not going to waste money and attorneys filing lawsuits against old women running mac's which can't even run kazaa.

Also, I am pretty sure they are only going to go after the big fry. Like this one dude that had 1,000,000 mp3's in his shared folder. I like to share, but 1 million is a tad too much. My 2c.
