Kicking my roomie out - feels so good!

Situation:

I covered his rent and utilities for October with the understanding that he'd pay me back ASAP

I built him a computer (he paid for the parts which cost $900) after he assured me that by the end of October, he'd pay me for the rent & utilities

Asked him on the 1st for the Novermber's rent, since its due in the first 4 days - he didn't have it & promised that he'd have the cash on the 3rd

On the 3rd, I asked him again for the rent, he said he'd have it on the 4th and would give it to the landlord in person ... trusted him and put paid my half of the rent (dropped off a check to the landlord)

On the 6th (yesterday morning), the landlord stopped by for some routine maintainance and informed me that my roomie still hadn't paid

Had a talk with him at 11:30am and told him that if the rent wasn't paid by that evening, I'd have to ask him to move out since I'm the one offically on the lease (my landlord didn't care)

At 3:00pm, I overheard him talking sh!t about me on the phone ... he didn't hear hear me come in thru the kitchen since he was being pretty loud and explicit in telling his girlfriend of what he thought about me. At this point, I told him to pack his stuff and move out by 3:00am.

Came back from the movies (Matrix ) at 12:15am and he wasn't in, nothing packed.

At 3:00am, I started putting all his stuff out - really not much at all

Its 4:20am now, all his stuff is out on the sidewalk - except for his computer which I'm going to keep as collateral till he pays me back



I thought I'd be all upset and mad, but I'm in a REALLY good mood now

You can't kick someone out like that. You have to issue a notice or something before you can physically move someone out.

Good luck if you get sued.

Make sure you change the locks on your door and be sure to update! Be careful though, he's probably going to think of some way for revenge.

As I understand it....the other guy's not on the lease at all. It's technically Vonkhan's place that this guy happens to be staying at. So Vonkhan has no legal obligations towards him. Someone correct me if I'm wrong (I'm not an expert) but doesn't that basically boil down to Vonkhan can kick his deadbeat ass to the curb without any notice and he can't say sheit about it?

I don't know the legal consequences of what happens if his crap gets swiped off the sidewalk in the middle of the night though...:Q

Sadly, the left wing domination allows anyone to sue anyone for whatever the hell they want. The tenants can sue landlord for totally ludicrous type of costs.

Basically, what its saying is that if you got kicked out for not paying rent, you can still sue the landlord for child care, motel cost etc while you're kicked out. I know.. totally retarded.

I won't be surprised one bit if the roomate can sue you for something equally retarded.

Thanks guys my friend's on his way back from Walmart with the locks ...

About me getting sued, hopefully not ... he's not on the lease, didn't pay the rent/utilities. As per basic contract law, I'm covered ... there's no contract without consideration for the last month or the present one (since he didn't pay). Even if he can prove that there was a contract, he's in breach of that contract.

Besides, he's an international student who's visa ran out 2 years ago ... he'd still be ok with that except for the fact that he's not registered for any classes this semester (SEVIS, the new foreign student tracking system by INS is useless!) and he's working off-campus without an INS permit Any sh!t from him and ... Hello, Immigration and Naturalization Services?




Edit: No, he's not back yet ... but the locks are here My friend who bought them has offered to help me install them AND stay up with me thru the night "gaurding" the place. Think he just wants the 6 pack of Labat Blue from the fridge!

hahah lol...pray your roomie doesn't know or hire any lawyers or tenant actavists. Your butt could be sitting in a muni court if he does. The law frowns on "self help" when it comes to housing issues....even if your roomie was a jerk.

If you just live in my apt or house and you are not on the lease in any way, shape or form and MY name is listed as "Lessor" on the lease, I can kick your ass and your sh1t all the way to the curb and there's nothing you can do about it.
