Theres nothing in this world worse (in this context) than a leech, someone who constantly takes the p|ss with regards to money and things like that. There is no basis for a lawsuit. The "homeless" roomate is now S.O.L. I'd imagine by now, an empty Whirlpool refrigerator box is looking pretty attractive to use as a home.

errr...bad idea...1) he had rights to live there until at least proper notice given, regardless of a tenant or long term guest; 2) without a lease between you he can claim pretty much he was to be living free and clear; 3) by placing his stuff outside he can now claim damages for losses, something like a 2 carat diamond ring he had for his g/f and crap would be possible...he could make a list and throw it to small claims court....they are usually pro-tenant, esp if he gives a sob story that you guys had an understanding of some sort.

Good luck with it, living with g/f's is hard enough for me to even consider a roomie.

It doesn't have to be. All he has to do is prove that was his primary residence. In Ca you would have to give him a 3 days notice to pay rent or quit (leave) Afterwards you would have to proceed with an eviction.(File a motion and go to court)
Also leaving his stuff out on the street can make you liable for anything damaged or ruined.

I think it would be easier just to turn his ass into the INS

If he's not a legal resident and especially since it sounds like he's here illegally at this point anyway (if he's not in school and his paperwork has expired), does this guy even have a foot to stand on in the courts? Do illegal non-citizens get to sue in our courts? I guess this would be a separate issue from whether or not he would be able to sue you for kicking his no-good mooching ass out in the first place .

hmm i don't know if anyone has stated it (just skimmed the stuff) but besides the fact you can get sued for throwing his stuff out and evicting him. you can also get busted for keeping the computer. If you had him move out and wont give him his computer then that is theft. NO you cant keep it until he pays you back. that was not the agreement.

But thats if he goes to the police. which if it was me (well i would have paid my rent on time heh) i would be screaming at the police station for theft and illegal eviction.
