Kicking my roomie out - feels so good!

You can't kick someone out like that. You have to issue a notice or something before you can physically move someone out.

Good luck if you get sued.
You missed this part:
Had a talk with him at 11:30am and told him that if the rent wasn't paid by that evening, I'd have to ask him to move out since I'm the one offically on the lease (my landlord didn't care)
The kid who is getting kicked out has -no- legal rights to that tenancy.
If this is brought to court, the only person held responsible would be the landlord, for having prior knowledge of a tenant living in his building without a signed lease agreement.

I wouldnt worry about getting sued for kicking him out.. I'd be worried about getting sued for throwing his crap out onto the sidewalk. He can claim damage and missing items and some stuff was stolen. Maybe get him to sign something saying all his stuff is there and in order when he finally does come to pick it up. That way he cant take you to court over that too.

It was an interesting morning

Around 8:30am I hear a loud banging on the door and guess who it is

Why, its my dear beloved roomie!

He wants to know why all his stuff is out on the sidewalk - and when I tell him the reasons and he gets even madder, threatening to f*ck me up, gonna call his people yada yada yada. My dog's going crazy (gets excited when people yell, stupid dog) and some of the neighbours are wondering what all the commotion is abput (see mad roomie, see stuff on sidewalk - do the math!)

At this point, I excuse myself and take a couple of steps backwards and pick up the phone and take two steps forwards and tell him that if he doesn't get off my front porch - I'd FIRST call the INS, then the cops. Dude flips out, goes totally dramatic and punches ... the wall Maybe the pain cleared up his head or something, but he turns and walks away, leaving all his stuff on the sidewalk.

So, I get my rear back in bed (hey, I was up nearly till 6:00am fixing those locks!) and it feels so good ... when ...

KNOCK KNOCK KNOCK KNOCK *RRRRRRRRRRRRRING* *RRRRRRRRRRRRRING* *RRRRRRRRRRRRRING* KNOCK KNOCK

aaaargh, I need my sleep but hello! its already 10:15am?!

My roomie's back at the door, crying and wailing his eyeballs out - doesn't have a place to stay, eveidently lost one of his part-time jobs a couple of days ago (never told me that before), no money ... the entire sob story

eh :S thanks for the tear-jerker story dude, but u cant stay here any more ... too much sh!t has already happened.

Called up my boss at the International Programs/Student Life Office and explained the situation to him. They're gonna put him in a dorm room for a couple of days and try to find a host family for him. One of the university's shuttle vans just picked him up a few minutes ago.

I still have his computer

A surprisingly good ending for that story.

Yeah, suddenly the tough guy wasn't so tough. Instead of being an a-hole he could have explained what's been going on with him losing the job and whatever else. But he chose to act like an ass and suffered the consequences. I still don't feel bad for him.

Congrats man! You managed to keep your dignity and be a badars, AND still be a cool guy by getting him a place to stay when it wasn't your obligation to do so. Not many people can say that.

Nice
Messing with the INS is definitely stupid in his part. I for one wouldn't attempt that.

But thats if he goes to the police. which if it was me (well i would have paid my rent on time heh) i would be screaming at the police station for theft and illegal eviction.
How can it be theft when the ahole name is not on the bills nor has he hold up to his part of the bargain.
And, I don't think that he would be screaming at the cop shop, since his Visa is long expired.

I had a roommate like that once & didn?t have the heart to throw him out. One of my female roommate end up doing what you did.

Good job!

I was going to say: take a video of him picking up his stuff off the sidewalk so if he sues you for damages to his stuff you can at least have evidence that HE picked it up and that it wasn't stolen or something. But nevermind. glad it worked out for you, good job.

I'm not gonna sell off his computer right away ... I'll give him a couple of weeks to pull his life back together. If he doesn't pay me pay by the 4th week of November - I'll put the computer on the FS/T forum

Paying the full rent is gonna give me a slight headache but nothing that I cant handle ... b'sides, I know a few people who want to move off campus

Thanks every1, all's well that ends well!

Besides, he's an international student who's visa ran out 2 years ago ... he'd still be ok with that except for the fact that he's not registered for any classes this semester (SEVIS, the new foreign student tracking system by INS is useless!) and he's working off-campus without an INS permit Any sh!t from him and ... Hello, Immigration and Naturalization Services?

You knowing that, you're guilty of harboring an illegal immigrant. If you get him in trouble with the INS, he'll get deported and you'll be charged with harboring him.

"Encouraging and Harboring Illegal Aliens

It is a violation of law for any person to conceal, harbor, or shield from detection in any place, including any building or means of transportation, any alien who is in the United States in violation of law. HARBORING MEANS ANY CONDUCT THAT TENDS TO SUBSTANTIALLY FACILITATE AN ALIEN TO REMAIN IN THE U.S. ILLEGALLY. The sheltering need not be clandestine, and harboring covers aliens arrested outdoors, as well as in a building. This provision includes harboring an alien who entered the U.S. legally but has since lost his legal status."

The defense: What he's an alien? I thought he said he was a Raelian! All this time I was afraid he was going to clone me! How was *I* supposed to know he was an alien? not my job to card him.

Good. Kick that lamer out of there! It's a shame not many of us don't have the balls to do what you did. I had a roommate who paid less than his share every month and I finally had it and yelled him out. None of my other roommats backed me up b/c they were bunch of pu$$ies, even though they would complain about him all the time.
