Assistant State's Atty. Cheryl Schroeder said during closing arguments that the defense had tried to sully the accuser's reputation and blame her for being raped.

"He tried to dirty her up," Schroeder said. "He is trying to say she deserves this."

But, she said, "They treated her worse than you treat a dead dog in the middle of the street. She had no idea what went on."

According the ruling of the case... sounds like she tried to dirty herself up. I feel bad that she made a mistake... but she did just that... made a mistake. And the mistake wasn't having sex... it was getting plastered.

yeah you are missing the ability to read the fcking report. She was not unconscious in fact she was kissing and stroking the guy on the head etc. NOT to mention she has changed her story from being unconscious to floating in and out of conscious to being drunk.

Ok I see that they released more information on the video. Im not sure that kissing and smiling are consent but it doesnt state specifically when it occurred. If it occurred during the act then I would say yes but I was under the impression that the guy was able to write the stuff on her legs during the act because she was passed out.

Well the report doesnt specify if that was during the act from the report i get the impression that most of the tape is leading up to the act.

i followed this *somewhat* in the papers....this happened not far from where i live.

SO...she was drunk and even stated *clearly* she does not remember ANYTHING.

She also refused to watch the video and also said she never saw the video.

Basically, what happened she doesnt even KNOW.

How then can she accuse someone of rape if she *admits* she has no clue what actually happened ?

You really think the judge, jury etc didn't watch it? besides the fact other reports (when the judge was going to force her to watch it) had said the jury and everyone would watch iteither way. It would be stupid for them NOT to.

Actually, if you wanted to be technical, yeah, it does...well, maybe not brutally, but raped, yes. In the states I'm familiar with, you are not LEGALLY able to give consent while under the influence of drugs or alcohol. Therefore, making the "mistake of being plastered" as someone so eloquently put it, does NOT justify rape nor is it a permissible defense for rape. With trials like this it is easy to understand why so many sexual assaults go unreported.
