There's a keen difference, one is legal, the other isn't.

The difference lies in killing the animal before you cook it, for god's sake. Plus, as a cultural thing, we rate cats highly, so it's socially unacceptable to kill a cat.

actually i would rate a cow far higher then a cat heck even a dog.

cats/dogs are just pets. though some dogs work so that helps. but a cow can be used for food, clothing, work, shelter and even pets (yes you can have a cow as a pet i have seen it!).

Uh, no duh. That's why we eat them. Cats are helper animals. We use them alive (kill mice, pests traditionally) -- so there is a social stigma to killing them. Also why a cow costs more than 99% of cats and dogs. That doesn't make it okay to cook them alive.

maybe because the guy has a mental illness. thats the only reason i can see them not charging him.

Not an unreasonable position. I eat meat and would never eat a cat or a dog, but I don't think one can ethically say it's OK to eat cows and pigs but not cats or dogs. As I said above, my concern in this particular case (assuming for the sake of argument that this wacko was actually planning to eat the cat) is with the fact that he was subjecting the cats to awful, unnecessary pain and terror. If someone wants to set up a farm harvesting cats for food, well, it seems distasteful to me, but I can't say it's ethically any different than a cattle farm.
