Dude, read your HOA rules and covenants. My HOA is composed of homeowners in the neighborhood. Under my HOA rules, it's a requirement to own and live here before becoming a HOA board member. I'd guess that your HOA is the same way.

Think of it this way - why the heck would people who didn't live in your neighborhood care at all about what trucks are allowed in your neighborhood?

If you have to ask this question, then you are completely useless to your father in this situation. How old are you?

Your father handled the situation completely wrong and he is going to be lucky to get out of this situation with his shirt.

BTW, I have represented HOAs and homeowners, so I actually know what I am talking about.

Get a lawyer and do it NOW.

I prefer living in HOAs. It keeps idiots from trashing up the neighborhood. The rules in my HOA are very reasonable and easy to follow. You don't have to live in one if you can't handle it.

I don't need a nanny to tell me how to cut my grass or what I can park in my driveway. If I want to drive a lifted 4x4 truck that is so damn big it won't fit in the garage, I'm going to buy the truck and drive it. Fuck HOA's that bitch that you can't park in your drive way, or you can't back into your drive way or you can't park on the street.

If you're ok with living in an HOA good, fine for you, but some of us like our freedoms and choose not to live under some retired shit face's boots.

My neighborhood has it bad enough with the yard nazi down the street that calls the city multiple times a day to complain about grass, cars, porch lights left on during the day, putting your trash out the night before pick up, yard signs during election times, and the kicker is he will go up to peoples gates to get the dogs riled up and then call the pound to file a noise disturbance ordinance. The pound has finally stopped taking his calls because I reamed them over that witnessing it happen. So now he checks gates to see if they are locked or not and if they are not he opens them to let the dogs out.
Every year he tries to get a petition signed to form and HOA, and Amazingly, no one signs it.

Double edged sword. My old neighbor started out cool enough... but after about a year he started parking old jeeps in his back yard t use for spare parts for his one working jeep.

Where I live there is a HOA... but the whole thing is only maybe 3-4 pages... not enough to be crazy but enough to keep crap like the above jeep parking stuff from happening.

4. The FMCSA definition you keep quoting might be irrelevant. It depends on the wording of the HOA rules. Have you read them yet? If not, you might want to reconsider the part about helping represent your dad in court.

5. Sounds like your dad just ignored the parking tickets. He should have used the grievance/dispute clause in the HOA rules to dispute the tickets. He can still try, and the petition signed by the neighbors can be used to help his case. Note that at this point, depending on the asnwer to point #3, you may have two different legal issues. One is with the HOA, and the other is with the enforcement company (or it's assignee).

6. The HOA Rules might give some way to appeal if he loses his case in HOA "court." Have you read the rules yet?

How do you appeal, what exactly do you do and what are the outcomes if successful? I'm not familiar with that term.

If any vehicle is parked on any portion of the Community in violation of this Section 9.6 i

towed. The notice shall include the name and telephone number of a person to contact regarding
the alleged violation. A notice also shall be conspicuousIy placed at the Community stating the
name and telephone number of the person or entity which will do the towing. If 24 hours after
such notice is placed on the vehicle, the violation continues or thereafter occurs again within six
months of such notice, the vehicle may be towed in accordance with the notice, without further
notice to the vehicle owner or user.

Park it in your garage or if it won't fit, ask the HOA where they have designated an approved parking area for such types of vehicles. The wording of the rules indicates to me that there should be such an area or why would they bother to put that part in there?

Has the HOA clearly defined what constitutes a commercial vehicle? If not, then you have some options here. However, I wouldn't take the Federal Motor Carrier Safety Association's definition as gospel here. You're in Georgia, and the laws in Georgia are the ones you need to examine.

So, I would find out if they really have a leg to stand on by calling the truck a commercial vehicle. Even if they do define it in the HOA bylaws, if the GA state laws or transportation code, or w/e say otherwise, you've got a fight on your hands.

If they're just flat-out wrong, hire an attorney who will counter-sue the bejesus out of them. They'll settle. You need a professional here - call a few lawyers who do free consultations, and see which one is ready to go to war for you.

When they filed suit did you answer their petition? You can always counter sue them for attorneys fees and defamation as well as harassment.
