Sony should be brought up on charges having their Execs face 120 years prison each and $815,000 fines each as well.

I don't get you people who's bashing dmcowen674. What he did and Sony did was "technically" same, but has COMPLETELY different motive.

Dave - DC Client = NO FINANCIAL PROFIT WHATSOEVER!

Sony - Spyware = 100% FINANCIAL MOTIVATION

That point alone should distinguish any one with 1 live brain cell that there is a huge difference between what Dave did and what Sony is doing right now. Do you want more convincing point? Ok, how about this

Dave - Punishment = Lose job, goes through hell with government beauracracy. Basically, the punishment inflicted heavy (financial) toll on him.

Sony - (Possible Punishment) = ~$1million fine, if it even REACHES that. Wow... a measly $1million, and guess what? Morons will foot the bill when they buy the latest Sony crap. Not to mention, the possibility of this hurting Sony's PR is next to nill.

This is a prime example of what kinda of twisted abuse can result from idiotic law called DMCA. I'm always baffled by US law how multi-billion dollar company has same (probably more) protection of law as an single person, yet they do not receive proportionate amount of punishment.

And so it begins. The computing dark ages are about to start.

With companies like Sony and Microsoft trying to "protect" their content they are making it harder and harder for end users to use a computer for simple tasks like checking email or even playing a CD and soon these end users will have enough and say screw it.

Sure some of the problems will be worked around by computer gurus but really, who wants to waste several hours to be able to play a simple music CD without having your computer get fracked harder then a drunken cheerleader after the homecomming game.
It's just freaking nutz to have to do all that work to listen to a freaking music CD where 10 years ago all you needed to do was put in the disk and jam.(A backwards leep)

Also with Vista's DRM thing for HD and Blue ray DvDs it makes your current monitor obsolete. Infact all the monitors and TVs in people's homes today will not work. You will not be able to play HD video content unless you shell out another $1000 or more for a monitor that supports the hardware encrytion. This will lead to even more people hacking the system or no one will pay for crap they can not use.



I really really hope Sony gets sue and loses badly. I also hope they have to pay the costs to fix any broken computers. I'll charge $150/hr to make such repairs because Sony would pay for it, not the end user(Contractors do this all the time after natural disasters and clean ups for someone elses major mistake).


P.S I believe this rootkit is in violation of the DMCA because this mal-ware bypasses digtial security inplace on computer systems. It would be fvery very sweet to have Sony and the RIAA fracked with their only legal weapon.

I think he was referring more to civil law. Where a $2,000 littering fine would really hurt your avarage joe making only 25k a year a $2,000 is nothing to a small businnes making 250,000k.

I believe in europe traffic fines are based on how much you make in a year in order to make the fine hurt equally based on income.

I'm still not quite sure if it's a good idea or not or if it would be a violation under equal protection(need to do a lot more thinking on this).



BTW, in response to your question. Bill gates would get 10 months probation and the poor guy gets the chair, lethal injection or the fireing squad. Maybe all three depending on the state.

Did the CD, by any chance, sport the good old CDDA logo? If not, buying it is a risk. Red book FTW, DRM DIAF.

This is hacking, and Sony should not not get fined: they should have to pay a per-incedent fine to anyone who bought a copy of one of those discs.

Lol. Dave (and the whole situation he had went through sucks don't get me wrong), who is by far one of the biggest - if not the biggest - troll in P&N but due to his being buddy buddy with the mods hasn't been banned yet. Most of his posts are simply attacks on Christianity or the right, but everyone gets their panties in a wad if someone says a "personal attack" on him. Cry me a river.

I have no idea what P&N is, what I do know is the more I read about new technology and it's restrictions the less and less I want to evolve to the new tech.
I'm sure more and more people will wake up to this fact and not purchase the new technology because all of the restrictions on how you can use it. Infact we may see a increase of "old technology" because there are no restrictions.

Man, I've better consult my history books to see what an 8 track and record was. these things might actually make a come back. Oh wait Hollowwood is trying to make recording in analog illegal too Look here

ps2 bought brand spanking new conking out with dre
they say i have to pay $45 to get a refurbished one that some fat kid has been playing jelly encrusted dvds on, or pay $79 to have mine repaired

How can anyone *possibly* be surprised by this? Sony are bastards and they always have been. They lie and distort the truth worse than any company I've *ever* seen just to sell products. They make Microsoft look like a pinnacle of virtue, for Chrissakes.

There's a simple solution here, folks: Don't buy Sony products. Don't buy their music, their movies, their players, their games--don't give them your dollars. Make Sony pay for their crimes by taking away your monetary support. It will do more good than any government action will, and more importantly, it is within your power to *ensure* that Sony doesn't get your dollars. All you have to do is make a choice and then follow through on it.

The offending technology was designed to thwart music piracy.

The controversy highlights the need for rules as to what content providers can and can't install on PCs to protect their property, said Russinovich, who is co-founder and chief software architect at Winternals Software, which specializes in advanced systems software for Microsoft Windows.

"We need to get some formality about what's legal, what's ethical and what's fair ? and what level of disclosure there needs to be," he said. "It's fine for Sony to say we're not going to do that now. What kind of guarantee do we have they're not going to do it at a future date or that other companies are not going to do this?"

Back to this article. Do you think installing rootkits is a good practice? Whether it is a BIG Company or your not so friendly neighbor kid. I personally wouldn't like to have one loaded on my machine from either source. Attacking another person does little to state how you feel about something IMHO. I think that that copy protection is a neccessary evil to protect intellectual property of the developers or artists painstaking work but when you start altering the system of the client to hide running processes you have installed mallware. And this is plain wrong and should be punished in the same way as if a hacker did that to your computer. Not just once but for every computer that they have done this to.

Agreed, but this whole rootkit thing is only part of a very very large ice burg called "Digital Rights Management" The more and more I read up on this and what Microsoft and the industries want to do you may end up buying CDs, DvDs and other media and then not be able to use it because the system killed every player in the world from playing that media because some hacker hacked it. So what if you paid 20 bucks for a DvD you can't watch. So what if Sony has to re-release an entire DvD moive so people can watch it. They will just charge 40 bucks for the 2nd release and 60 for the 3rd
