Scheduled a formal hearing and told the judge I was looking for street signs trying to figure out where I was and didn't see the stop sign. Asked for leniency since this was my first offense. He dropped the points that would have gone on my license and cut the fine in half.

You will usually receive a better result in person then by sending in a letter though. I really would not rely on a letter unless you have proof (documentation) that you are innocent.

True, I wouldn't drive 26 hours though to show up at court.

wait, let me get this straight. You are sending a letter, to the Judge, admiting that you are guilty and were acting recklessly and because of that you think you are going get the ticket thrown out.

You sir are really stupid if you actually think this will work.

IMPORTANT

Never use the "I didn't see the sign" excuse unless you can prove the sign was not their or obstructed.

Two reasons:
This defense is an excuse and the judge won't care.

Your insurance company will read this as "inattentive driving" and drop you like a bad habit.


Also remember that just because you need something or want something to work a certain way, your need doesn't make it happen.

You might as well just pay the fine. With that letter, it's an open and shut case against you. You have admitted fault, excuses won't sway the judge in your favor. It's better to remain silent and pay the fine, and be though a fool than submit that letter and remove all doubt.

I have nothing better than the letter to write though. I think I will take out the not paying attention to road though. I did appreciate the notice of that mistake. Maybe I should offer something obscure. Mention I'll do community service or something of the sort. I don't know. Alls I do know is that I can't make it. The money is not the question, its the insurance and the points on my license that cause the biggest problem.

no no leave it in. you need a reason for missing the sign. otherwise its just a whiny note.

you might mention you were drinking or smokeing pot also.

First: Its in your best interest not send that to the judge. He just may issue a bench warrant for your arrest for just being a dumbass.

second: The Judge doesnt care and its not trial. you have to go to the city attorney first and see if he will plea bargin it down. if he offers you a plea bargin and you accept the plea bargin THEN you go to the judge and plead guilty to the lesser charges.

if you dont accept the lesser charges then you go before the judge and plea not guilty and take it to a trial. of which point the city attorney is going to throw everything he can at you for wasting everybodys time.
