The justice system is truly blind. I have a completely clean driving record. Quite literally a blank page. I hit a deer driving home a month ago, and called the police to come out and make a report. The officer realized my drivers license had expired on my birthday 3 weeks ago - so he arrested me. Luckily my wife was already on her way with a friend, because he called a towing company to come impound the car as well. Insurance was up to date, registration was up to date. I had merely forgetten to renew my license. What many folks don't realize in Michigan is that it's a CRIMINAL offense, not a traffic or civil infraction. That means you need to go get a lawyer immediately and you get arraigned and the whole spiel. It's a multi-year fine along with up to 6 months in jail. For a first offense.

Alabama? 90 day grace period, no problem.

Other states make it a civil penalty. Some don't have a penalty at all other than a late fee.

It's pretty fucked up, really. My wife got pretty upset with the judge at the arraignment. She asked if he thought he was serving the community by taking a engineer who volunteers his time 6 months out of the year and hasn't had a speeding ticket in 13 years off the street.

When you venture into a federal offense, they can essentially do what they want.

The victims were celebrities. Let's call a spade a spade ... we are "normal" folk, they are celebrities. Typically crimes associated with "celebrities" get treated "differently" than do "normal crimes. (inferences stressed).

I was once told by a retired lawyer that yes, you can buy "justice" in this country IF you have the means. A typical example of the haves and have nots ...

That was just the arraignment. Since I'm an actual hardened criminal for forgetting to pay $18 to renew a license, I still have the trial coming up in a couple weeks. I should be a dick and demand trial by jury. If they're gonna screw with me, why not return the favor?

I see you've experienced the joy of our legal system first hand. I had the pleasure of being involved in a lawsuit that, basically, would not have been possible in the western half of Michigan but because it was filed in the Eastern District it was allowed. Quite eye opening to realize that even though I was in the same state I could have been spared from the time and costs of the legal system if I lived just a short distance to the west.

So..... what if you had been overseas in the military when it expired? That's a nice FU. So Even though you weren't driving it at the time they still took it.

Err don't American driver's licence expire on your birthday like ours?

I have done the forget to renew plate sticker thing, but cop just makes me go get a sticker and show the proof at the station since my insurance was up to date. With a fine of course.

Yes (at least for most states, can't speak for all) - he stated that it expired on his birthday 3 weeks prior. But you don't renew every year, they are good for 8 years in my state so it's not something you constantly think about and it's easy to let slip. FFS, give the guy a ticket, let him get the renewal done, and go to court and apologize to the judge and have it dismissed.

If it makes you feel better, I was pulled over for speeding in Texas, with a year old expired DL (just never got around to renewing it). The cop gave me a ticket for it, I renewed my license the next day and had the ticket dismissed. You need to leave that dump of state.

I'd be careful, that borders on trying to implement jury nullification...a guy got arrested in MI a couple of years ago for passing out pamphlets informing jurors of their rights.

My state of GA has jury nullification so I'd be all over that.

Yep, cops can be dicks no matter where you are. For instance, a decade ago a friend was leaving his car at my place as he was an OTR driver and didn't want to leave it at the apartment complex. he would be gone a week to a month at a time. Just a week earlier I went with him to get his tag renewed. He wanted to wash the car before putting the new tag on. Got the car washed, but forgot to get the new sticker out of the glove box.

He leaves town, his car sits in my driveway and a week passes. Then he calls asking for a pickup as he is back in town. I drive his car to get him and get pulled over for an expired tag. I show him the new sticker still on the paper form the DMV provided along with up to date insurance, my clean driver's license, etc., but that made no difference. I was cited and a mandatory court appearance. Thank you fucking Gwinnett County, GA. May your children all be inbred (not from GA).

Not to further derail this thread, but what you're saying about Eastern/Western doesn't really make sense. Assuming this is federal court, both the Eastern and Western Districts have a multitude of judges (currently 23 in the Eastern District and 5 in the Western District). None of those judges is bound by the decision of any other district court judge (within Michigan or otherwise). They are all bound by the decisions of the United States Court of Appeals for the 6th Circuit.

Now, if you happen to get the one Western District judge that was confronted with the same issue before and unequivocally said X, I agree it's unlikely he's now going to say Y. But that's a far cry from what I think you said in your post.
