Man Says Obscene Gesture Is Free Speech

PITTSBURGH - A motorist believes the constitutional right to free speech includes obscene hand gestures.

Thomas Burns, of New Castle, contends he was denied his First Amendment free speech rights when he was cited for giving an obscene hand gesture to a construction worker in April, according to a federal lawsuit filed Monday in Pittsburgh.

Burns had become frustrated with a traffic delay and showed the gesture at a construction worker. The worker reported it to a police officer, who cited Burns for disorderly conduct, according to the lawsuit.

The citation was dropped, but Burns filed a lawsuit because he believes he was maliciously prosecuted.

The "finger gesture was not accompanied by any verbal threats, taunting or communication and was never visible to anyone other than the workers," the lawsuit states. "The gesture, albeit insulting, had no sexual meaning, did not appeal to anyone's prurient interest, and did not create a public disturbance or breach of peace."

The chief of the police department that cited Burns _ in Center Township, Beaver County _ declined comment Tuesday, saying he hadn't had a chance to discuss the case with the department's attorney.

In recent years, Pennsylvania courts have ruled that the gesture doesn't automatically constitute disorderly conduct, because it is not "obscene" as defined by the law, unless it is used in a clearly sexual context.

Lets pretend that you are right, that it is silly and doesn't get anybody bent out of shape. In that case, why would people feel the need to give a hand gesture?

You can't have it both ways. If it were meaningless, no one would do it. If it is meaningful, then people get bent out of shape.

Yes, but it is the classic "Scream 'FIRE' in a crowded theater" scenario. Just because we can say something doesn't mean that we can without consequences. I have no right to go and verbally (or otherwise) abuse someone without consequences.

It reminds me of a story when I was living in Michigan. Some guy is out playing in a lake when something happens that hurts. He then spends the next 5 minutes yelling "Fvck" over and over again at the top of his lungs with dozens of people and children around. He claims he was just joking around and having fun with his kid (free speech and all that) but he was charged with disorderly conduct.

How come many people confuse free speech with "being a jerk" instead of "being able to make controversial political statements without being oppressed by the government?"

Thats how I understood it.

Disorderly conduct is the old "catch all" charge for when they don't have any actual crimes to charge you with. They should just change it to "being a jerk" already, because thats what it amounts to it seems.
