Maryland PBJ question

Does anyone happen to know the duration of a probation before judgement (PBJ) ruling for a speeding ticket in Maryland? My googling can't pin down a number - it seems to be either 1, 3, or 5 years.

I got a speeding ticket 4-5 years ago, appeared in court, and received PBJ (no points on my license unless I get another ticket within X years). Lucky me, I scored another ticket today and I'm trying to figure out if I "violated" my probation from my previous ticket and I'll be hit with points.

Actually, I'm not sure if PBJ would be different state-to-state, or even ruling-to-ruling, but any help would be appreciated. Danke.

no clue, but i do know that the felony i was arrested for in June 05 will be able to be expunged this june (after 3 years).

if a felony gets expunged after 3 years and a speeding ticket doesn't, i think i'll be a little pissed :beer:

Generally you must wait three (3) years after your case was decided before you can file for expungement, but the rules vary based on the results of your case:

* If you were acquitted or received a nolle prosequi or dismissal of the charges, you may file earlier if you also file a general release and waiver of any and all people against whom you may have a legal claim as a result of your arrest.
* If you received a probation before judgment, you may not file for expungement until your probationary period is over or until three (3) years have passed, whichever is longer
* If your case was placed on the stet docket, you may not file earlier than three (3) after the judgment.
* If you were pardoned by the governor, you must wait at least five (5) years but not more than ten (10) years after your pardon.


I'm assuming if you can expunge after 3 years, means the probation period is <= 3 years

What felony was this?

I assume you were a minor when this felony was committed purbeast0? and you're going to be turning 18 this year?

Felony's don't get expunged unless you were under 18, or have a connected lawyer.

The conditions of probation are generally laid out by the judge - and he likely assigned
you a time period to behave yourself, it should be written in your court documents.

Probably 1 year. Certainly not 4-5.

Generally, violations are only considered even for insurance purposes out to 3 years.

You could always go in with "guilty with reason" and the judge probably won't even
check your previous record if you tell him you had one ticket 5 years ago.

Don't hold me to that, but judges in MD want traffic in and out ASAP. But it depends
on what county, what day, what judge and what he/she had for breakfast to really
get to the science of it.

EDIT - I HATE that you can search public records like that.

It's one thing to make information available. But you can go on that site and find out salaries, phone numbers, addresses, places of work, friends, payment information, cars, names, family, previous addresses, etc.

Way too much.
