I just want to be the one to let you know you're a little bit insane.
A drunk driver hitting somebody has caused permanent, obvious damage. Honestly, the average girl getting this is going to freak out and scream about how gross it is and yeah it will be shocking, but it's not like she's going to need counselling.
Speaking as to whether it was intentional, regardless of the severity of impact on the victims: There is absolutely no comparison between this and drunk driving. Considering that the actual mechanic of the incident was
accidental sending to a whole list of people, it compares more to hitting the gas while the transmission is in reverse when you thought it was in forward.
Also, I could have sworn we relied on something in the U.S. called "reasonable doubt". I'd say that unless this person has a history of inappropriate contact with others, it provides reasonable doubt that it was done on purpose.
Now, if there's a law out there that makes this criminal regardless of being an accident or not, I don't know. But it seems to me that such a law would be needlessly harsh. Is sexting, by itself, illegal? If not, then why should
accidentally sending them to others (underage or not) be illegal?
