McDonald's Fat Suit Back On

NEW YORK (Jan. 26) - An appeals court revived part of a class-action lawsuit blaming McDonald's for making people fat, reinstating claims pertaining to deceptive advertising.

A three-judge panel of the 2nd U.S. Circuit Court of Appeals said Tuesday that a lower court judge erred when he dismissed parts of the lawsuit brought on behalf of two New York children.

U.S. District Judge Robert Sweet dismissed the lawsuit in 2003 because he said it failed to link the children's alleged health problems directly to McDonald's products.

But the appeals judges said New York's general business law requires a plaintiff to show only that deceptive advertising was misleading and that the plaintiff was injured as a result. The panel upheld other parts of the dismissal.

In a statement, Oak Brook, Illinois-based McDonald's Corp. said "common sense tells you this particular case makes no sense," adding the ruling "simply delays the inevitable conclusion that this case is without merit."

A message left for the lawyer representing two children named in the lawsuit was not immediately returned.

The lawsuit alleges that tens of thousands of children have suffered obesity, diabetes, heart disease, high blood pressure, elevated cholesterol and other health problems after being misled about McDonald's products.

Sweet ruled that consumers cannot blame McDonald's if they choose to eat at its fast-food restaurants.

"If a person knows or should know that eating copious orders of supersized McDonald's products is unhealthy and may result in weight gain," Sweet had written, "it is not the place of the law to protect them from their own excesses."

I read a magazine say that
double cheeseburger is one of the "healthy mcdonald's food" that is low in fat

Actually, any intelligent person should realize Supersize Me did not prove McDonalds is "bad" but that force feeding yourself 6000 calories a day and eating even when you are not only full, but sick is bad for you.

He could have done the same thing with your Mom's cooking and had the same results.

When you force feed ANYTHING, it causes obesity and enlarged livers. Look what they do to Geese to make foie gras. They force feed them to cause their liver to enlarge.

People should take all the responbsibility for their actions. They knew that burgers and fries made them fat but they didn't stop.:roll: So it's their problem(people who eat fatty stuff) not mcDonald's.

Any food, when eaten to excess can make you fat.

Plenty of people eat McDonalds in moderation and are not fat. I eat their burgers quite often.

Did you see the extras on the dvd where he put some mcdonalds food and some non fast food in jars and let them sit for weeks on end?

The mcdonalds fries didn't break down at all, they were in flawless condition 2 months after being cooked. Propaganda film or not, that turned me off from mcdonalds fries.

You could do the same thing with most foods that contain preservatives - deep fry up up some ore-ida potatos from your local grocer and put it in a jar and see what it will do. Same thing for egg rolls, potato chips, and pretzels.

It means there is enough perservatives in there to stop the natural process of decay. The other jar had fries from your local diner, they were moldy within days.

Everything that was mcdonalds in the jars took at least three times as long to even start the decay process. It was just gross

That being said, I'm not anti-mcdonalds by far. I went out and got a big mac right after the movie was over. It was warm and rich, went down like butter.

You could do the same thing with most foods that contain preservatives - deep fry up up some ore-ida potatos from your local grocer and put it in a jar and see what it will do. Same thing for egg rolls, potato chips, and pretzels.
All the fries I've ever had have actually started to mold over at some point. Point was that fries from a regluar mom and pop burger joint started to decay like normal food does. I'm guessing their fries are frozen and contain perservatives as well. They were definatly not fresh cut potatoes.

Drive by early enough to get breakfast and you can usually see them unloading the trailers with crates of fries that have the words "KEEP FROZEN" all over them. I'm not sure if anything they serve is ever "fresh" except perhaps their salads and cheese. I suspect their cheese is so processed as to make Velveeta seem like cheddar, and would probably petrify before molding.

I don't know what McD's puts in their fries, don't really care to be truthful. I just know that we eat potato chips (that are nothing more than deep fried potatos) that can sit in a bag unspoiled for months on end.

The only real control way to test would be to have a group without an agenda conduct the same test using fries from multiple fast food companies, a couple from mom & pop stores, and some from a grocery store.
