medicaid discontinued without due process in Indiana

My disabled brother in Indiana got a notification letter on the 9th that he would have a phone appointment on the 8th. On top of that they used the wrong phone number to try to call him so he wouldn't have been able to receive the call in any case (it was the sprint cell phone my parents got for him but he has no signal at his apartment half the time.) So because he didn't answer the phone call he couldn't have gotten the day before he received notification that he would get it, his medicaid benefits have now been discontinued.

I'm broke and am just starting a new job in two weeks after being laid off in August, so I can't really do anything. Any Indiana lawyers in the house? Anyone know a good Medicaid advocacy lawyer in the Lagrange, Indiana area?

Edit: To clarify yes they were supposed to call him again today but didn't. He called them and apparently their grounds for discontinuing coverage is that he didn't answer their call on the eighth. Of course his disabilities inhibit his coherency so it's hard to be sure exactly what went on.

When was the letter actually dated? When was it postmarked? If it was dated and postmarked well before the 8th, then that's not medicaid's fault.

Also, why on earth does your brother list as his contact number a phone that he knows will not successfully contact him most of the time? That doesn't make any sense at all. He has to know that this is an important contact number and yet he lists a number that is effectively un-reachable much of the time.

Logic tells me that there's more going on here than you are telling us in your post.

No no, this is obviously the system's fault.

Also, disabled.... LOL! I have met many people on disability, though I'd have to say that most of the time, the only disability I saw was ethical.

call Legal Aid for that particular county. they should have a few attorneys that can help with disability related issues.

Ummm...is your brother doing this on his own? What I mean is, if he is eligible for medicaid they aren't just going to say, "sorry, because you missed an appointment you aren't allowed to be on medicaid anymore."

call them. set up another appointment. go to the appointment. get any medical expenses incurred while your brother was in medicaid limbo retro-payed. they will do this.
